HomeMy WebLinkAbout194-91 RESOLUTION NO. 194-91 COMMITMENT OF SOLID WASTE STREAM TO A PUBLICLY-OWNED SOLID WASTE FACILITY OWNED, OPERATED OR REGULATED BY THE CENTRAL CONTRA COSTA SOLID WASTE AUTHORITY WHEREAS, Central Contra Costa Sanitary District (Central San) has controlled garbage collection in Danville longer than the Town has been incorporated and is legally authorized to continue to do so until March 1, 1996; and WHEREAS, as franchisor, Central San controls decisions concerning award of the franchise for garbage collection, the establishment of garbage collection rates annually and control of the waste stream; and WHEREAS, approximately a year ago, Central San, along with the cities of San Ramon and Walnut Creek, formed the Central Contra Costa Solid Waste Authority (commonly referred to as the "small JPA".) The JPA's intended purpose is to coordinate Central County solid waste activities and to pursue public ownership of a transfer station which would also serve as a recycling and resource recovery facility to achieve AB 939 mandates; and WHEREAS, as a result of Contra Costa County's decision to take over franchising in the unincorporated areas of the County, Central San is evaluating its future role in solid waste planning and management; and WHEREAS, negotiations are ongoing between the County, the Authority (small JPA) and certain private entities with the objective to acquire a site and construct a publicly-owned transfer station; and WHEREAS, such a facility would most feasibly be financed through revenue bonds or certificates of participation; and WHEREAS, in order for such bond financing to occur, all entities which presently have, or may in the future have, control of the waste stream will need to commit their waste stream to the public facility for the duration of the bond repayment period; and WHEREAS, Central San wants a know whether Danville is willing to commit our waste stream on a long-term basis to a publicly-owned solid waste facility owned, operated or regulated by Central Contra Costa Solid Waste Authority (small JPA); and WHEREAS, Danville will likely become the franchisor during the 20 - 30 year expected life of the bonds, Central San is requesting that Danville independently commit our waste stream to such a facility; now therefore be it PAGE I OF RESOLUTION 194-91 RESOLVED by, the Town Council of the Town of Danville that the Town supports the concept of a publicly-owned solid waste facility owned, operated or regulated by the small JPA and is committing our solid waste stream to the planned publicly owned transfer station being purchased by the Central Contra Costa Solid Waste Authority (small JPA).
