APPROVING HERITAGE RESOURCE DESIGNATION AND A
HERITAGE RESOURCE INCENTIVE PACKAGE FOR THE EDDY HOUSE
LOCATED AT 302 SOUTH HARTZ AVENUE
(APN: 208-022-005)
WHERF~S, Doug Oftenhartz (owner and applicant) is proposing to preserve the existing
one story building located at 302 S. Hartz Avenue (APN: 208-022-005) and add a 3,000
+/- square foot, two-story addition at the rear of the site; and
WHEREAS, the proposal also includes the addition of an outdoor seating area, removal
of the existing lean-to porch located at the rear of the existing building, and movement
of the existing building west to Hartz Avenue and south toward the San Ramon Valley
Times building; and
WHERF~S, the applicant is requesting Heritage Resource Designation and approval of a
Heritage Resource Incentive Package; and
WHEREAS, two members of the Heritage Resource Commission and two members of the
Design Review Board met on three occasions to evaluate the proposed project
architecture; and
WHEREAS, Ordinance No. 89-8 (Historic Preservation) of the Town of Danville establishes
standards for review for alterations to designated Heritage Resources; and
WHEREAS, the Heritage Resource Commission staff report of April 17, 1991 supported
approval of an incentive package and designation of the building as a Heritage Resource;
and
WHEREAS, the Heritage Resource Commission at their public meeting on April 17, 1991,
adopted Resolution 91-1, recommending the Town Council approve the proposed project,
granting the Heritage Resource Designation and approving the Heritage Resource
Incentive Package; and
WHEREAS, the Planning Commission held a meeting on April 23, 1991 and
recommended that Town Council approve Development Plan request DP 91-11, Land Use
Permit LUP 91-9 and Variance request VAR 91-17; and
WHEREAS, the Town Council did hear and consider all reports, recommendations and
testimony submitted in writing and presented at the hearing.

BE IT FURTHER RESOLVED, that the Town Council makes the following findings in
support of the requested designation of the Eddy House as a Heritage Resource:
1. That the Eddy House was constructed in approximately 1894.

That the Eddy House is representative of a particular architectural style,
namely, Victorian "Stick".

That the Eddy House is representative of the evolution of downtown
Danville.

That the Eddy House is associated with persons who have made a
meaningful contribution to the community as the Eddy family was one of
the original pioneering families in the San Ramon Valley area and owned
the subject House from 1903 - 1946.

The Eddy House is a familiar visual feature in downtown Danville and is
located at a prominent corner (South Hartz Avenue and Church Street),
located at the approximate center of downtown Danville.

That the applicant is requesting approval to relocate and restore the Eddy
House to provide for its continued use as a commercial structure.

That the proposal to continue the commercial use of the House is consistent
with the Danville 2005 General Plan and conforms to the DBD; Downtown
Business District.

That the applicant will proceed diligently and expeditiously with the
relocation and restoration of the Eddy House; and
BE IT FURTHER RESOLVED, that the Town Council approves the following Historic
Incentive package for the property;

Waiver of all parking in-lieu fees for 46 interior restaurant seats located at
the Eddy House restaurant/bakery, with the waiver set at the maximum
amount of $63,000.

Relaxation of development standards, including front and side yard setback
requirements.

Waiver of all Planning Division fees for the Development Plan, Land Use
Permit, Variance applications and environmental review fee with the waiver
set at the maximum amount of $2,100.

Waiver of estimated Engineering Division fees, not to exceed a maximum of
$700.
5. Expedited processing of permit applications.
6. Application of the Historic Building Code to the Eddy House.

Agree to consider possible waiver of any future beautification assessments,
subject to the approval of the Danville Town Council. If such a waiver is
applied, all designated Heritage Resources shall have the same
consideration.

Agree to support in concept and authorize process request for participation
in a Mills Act Contract with the Town of Danville for the Eddy House. (Note:
there shall be no reduction in property taxes for the addition.)

Direction to include the site in a future brochure of historic structures and
sites in Danville.

Authorization to prepare an identification plaque designating the Eddy
House as a Heritage Resource and to arrange an appropriate dedication
ceremony.
APPROVED by the Danville Town Council at a Regular Meeting on July 16, 1991, by the
following vote:
