AUTHORIZING THE PREPARATION OF A GENERAL PLAN AMENDMENT FOR
PARCEL J OF SUBDMSION 7480 (APN #206-010-043)
WHEREAS, Section 65350 et. seq. of the Government Code of the State of California
prescribe the procedure for adopting and amending the Town's General Plan; and
WHEREAS, on October 5, 1991 the Danville Town Council adopted the Danville 2005
General Plan for the Town of Danville; and
WHEREAS, due to the identified need to provide quality child care within the Town of
Danville and a recent request to consider an expansion of the allowable land uses on
Parcel J of SD 7480 (previously identified on Final Map 7480 to be reserved as a child
care site), with said expansion of uses to include a private school use and other, similar
public and semi public type uses, the Danville Town Council directed staff to conduct a
General Plan Amendment Study of Parcel J; and
WHEREAS, the Town Council did consider the request for authorization of a study of
Parcel J of SD 7480 on July 2, 1991; and
WHEREAS, a staff report was submitted recommending that the Town Council take action
to authorization preparation of a General Plan Amendment Study to amend the land use
designation from General Open Space to Public/Semi-Public and to authorize
approximately 40 hours of Staff time to be dedicated to the General Plan Amendment
Study.
WHEREAS, the Town Council hereby finds that a General Plan Amendment Study of
Parcel J of SD 7480 is appropriate and is in the public interest for the following reasons:

Since the approval of the Danville General Plan on October 5, 1987, there
have been several land use changes in the area.

General Plan Policy 7.10 encourages the development of quality child care
facilities in appropriate locations, especially in conjunction with park and
private common areas, and church facilities. These uses are not allowed on
lands with General Open Space designations.

The goals and policies of the draft 1991 Child Care Update Report
recommend that the Town take a proactive role in the support of new build
to suit child care facilities.

The proposed Study Area appears to be appropriately situated for a child
care/private school development because of its access from Crow
Canyon/Camino Tassajara and its proximity to open space areas.
WHEREAS, the Town Council did hear and consider all reports, recommendations and
testimony submitted in writing and presented at the hearing;
NOW, THEREFORE, BE IT RESOLVED THAT the Town Council of the Town of Danville

concurs with the reco,...nendations of staff as outlined in t.. July 2, 1991 Staff Report
prepared for this matter and authorizes the preparation of a General Plan Amendment
Study as indicated above; and
BE IT FURTHER RESOLVED THAT, in authorizing the above mentioned General Plan
Amendment Study, the Town Council is not indicating any predisposition to approve the
requested General Plan Amendment.
