HomeMy WebLinkAbout127-91RESOLUTION NO. 127-91 APPROVING THE WAIVER OF CHILD CARE IN-LIEU FEES FOR ASSESSORS PARCEL NOS. 206-010-031 AND 206-010-032 (PARCELS B & C OF MS 856-88) FRONTING ON THE SOUTH SIDE OF CAMINO TASSAJARA WEST OF ITS INTERSECTION WITH CROW CANYON ROAD WHEREAS, the Town of Danville requires payment of a Child Care Facilities Fee in the amount of $0.25 per square feet of leasable area for commercial projects, as established in Ordinance No. 89-2; and WHEREAS, Diablo Ventures West (Knoedler/Johnson) is requesting a waiver from the established fees on Assessor's Parcel No. 206-010-031, a 4.79 acre site with an approved retail use with 36,500 square feet of leasable area and a projected additional 4,000 square feet and on Assessor's Parcel No. 206-010-032, a 1.14 acre site with a projected leasable area of 15,642 square feet; and WHEREAS, the request for the waiver of fees is based on the previous creation of a non- exclusive grant of access through a portion of Assessor's Parcel No. 206-010-031, appurtenant to (Parcel J of SD 7480) Assessors Parcel No. 206-040-043 and said grant of easement was recorded on October 31, 1991. NOW THEREFORE, BE IT RESOLVED, by the Town Council of the Town of Danville that the Town Council hereby waives all child care fees to be collected on Parcels B and C of MS 856-88 (estimated at approximately $14,035.50) in acknowledgement of the previous granting of a non-exclusive access easement through Parcel C of MS 856-88 to benefit Parcel J of SD 7480, thereby enhancing the probability of development of a child care use on Parcel J.
