RESOLUTION NO. 121-91
APPROVING AND CERTIFYING MITIGATED NEGATIVE DECLARATION
OF ENVIRONMENTAL SIGNIFICANCE, APPROVING MASTER PLAN FOR THE
PUBLIC LIBRARY AND MEETING ROOM FACILITY AND AUTHORIZING
SUBMITTAL OF AN APPLICATION FOR CALIFORNIA LIBRARY
CONSTRUCTION AND RENOVATION BOND ACT FUNDS
WHEREAS, In November 1988 the voters in the State of California passed Proposition 85
authorizing the sale of $75 million in bonds for the construction of libraries within the
State; and
WHEREAS, In November 1990 the California State Library adopted Library Bond Act
Regulations including a pre-application and application process for jurisdictions interested
in receiving funding; and
WHEREAS, The Town of Danville did submit a pre-application on November 21, 1990 and
received notice on December 17, 1990 that Danville was ranked 35 out of 104 applicants
and was determined to be competitive; and
WHERF~S, Proposition 85 grant application was submitted on February 15, 1991 which
was subsequently denied; and
WHEREAS, on May 21, 1991 the Town Council directed staff to resubmit an application
due July 19, 1991 for an 18,000SF building; and
WHEREAS, the grant regulations require a resolution certifying the project budget, the
local funding commitment, supplemental funds and the application; and
WHEREAS, the Town has prepared and circulated for public review a Mitigated Negative
Declaration of Environmental Significance pursuant to the California Environmental
Quality Act (hereinafter "CEQA"), in connection with the development contemplated by the
June 1991 Master Plan for the Public Library and Meeting Room Facility (Master Plan);
and
WHEREAS, such Mitigated Negative Declaration is based upon an Initial Study conducted
pursuant to CEQA; and
WHEREAS, such Mitigated Negative Declaration declares that the development
contemplated by the Master Plan may have a significant adverse impact on the
environment, but that the mitigation measures contained therein reduce such impacts to
an insignificant level; and
WHEREAS, such Mitigated Negative Declaration, which is incorporated in full herein by
this reference, contains a Mitigation Measure Reporting Program as required by CEQA;
and
WHEREAS, The Town makes the following findings in connection with the approvals
contained herein:

The Initial Study prepared on the Master Plan concluded that development
pursuant to the Master Plan could have a significant effect on the
environment;

Changes or alterations to the development have been incorporated into the
Master Plan, which mitigate or avoid the potentially significant effects
identified in the Initial Study;

The Initial Study and Mitigated Negative Declaration have been prepared
and completed in compliance with CEQA;

The Town Council has reviewed and considered the information contained
in the Initial Study and Mitigated Negative Declaration, together with public
comments on such documents, and finds that there is no substantial
evidence that the project represented by the Master Plan will have a
significant effect on the environment; now therefore
BE IT RESOLVED, by the Danville Town Council that the proposed Mitigated Negative
Declaration for the Library Master Plan is hereby approved; and be it
FURTHER RESOLVED, that the Danville Town Council approves the Master Plan for the
Public Library and Meeting Room Facility; and be it
FURTHER RESOLVED, that the Town Council of the Town of Danville hereby certifies
the following:
1) The project budget contained in the application;
2) The Town of Danville is committed to provide the required 35% matching ~,
funds as specified in the project budget; :
3) The Town of Danville has the ability to finance any supplemental funds that
may be necessary to complete the project in a timely manner;
4) The local matching and supplemental funds will be available when needed to
meet the project's cash flow requirements; and
5) All information contained in the application form is to the best knowledge of
the Town Council true and accurate; and be it

FURTHER RESOLVED, that the Mayor of the Town of Danville is authorized to sign and
submit an application for California Library Construction and Renovation Bond Act Funds.
PASSED, APPROVED AND ADOPTED by the Town Council of Danville at a regular
meeting on the 2nd day of July, 1991, by the following vote:
