RESOLUTION OF THE TOWN OF DANVILLE REGARDING AB 939 RECYCLING FEE
WHEREAS, AB 939 allows for the collection of revenue to finance AB 939 planning and
implementation;
WttEREAS, the Board of Supervisors of Contra Costa County (County) has advised the
Town that its revised AB 939 budget and revenue projections will allow for collecting an
80C/ton AB 939 surcharge at the landfills on behalf of the cities without any increase in
the surcharge;
WHERF~S, expenditure of the surcharge revenue would be within the sole discretion of
the Town and the County has no responsibility to verify the appropriateness of such
expenditures;
WHEREAS, the Town intends that revenues will be used for AB 939 purposes;
WHEREAS, the Town recognizes that the County will send payments quarterly following
receipt of payment to the County from the landfill/transfer station operator and that the
first payment will be for the period of July - September 1991;
WHEREAS, unless terminated earlier by the Town, the County intends to collect and
disburse the surcharge until January 1, 1995, at which time participating cities and the
County will assess its continuance; now therefore he it
RESOLVED that the Town of Danville hereby requests Contra Costa County to continue
to collect the 80C/ton surcharge at the landfill/transfer station and disburse it to the Town
and other participating cities with a preference for a population based formula as follows:

x 80¢ x Landfill/Transfer Station Total Tonnage,
(provided however that all cities will
receive at least $10,000 per year)
