HomeMy WebLinkAbout109-91l~, RESOLUTION NO. 109 -91 A RESOLUTION FOR TIlE SALE OF EXCESS CRP FUNDS WHEREAS, the Town Council has previously approved funding for the E1 Cerro Bridge Project; and WHEREAS, the Town has received a CRP grant for the project; and WHEREAS, the City Engineer has determined that there are excess grant funds; and WHEREAS, the Alameda County Transportation Authority wishes to purchase the excess CRP funds as described in the proposed Purchase Agreement; now, therefore, be it RESOLVED, by the Town Council of the Town of Danville, that the Mayor be, and hereby is authorized to execute, on behalf of the Town, a written contract with the Alameda County Transportation Authority for sale of CRP funds, in the form as lodged with the City Clerk, together with such changes as may hereafter become necessary, provided such changes do not materially increase the obligations of the Town thereunder, and the City Clerk is hereby directed to attest same and affix thereto the official seal of the Town. APPROVED by the Danville Town Council at a regular meeting on June 16, 1991, by the following vote: AYES: GREENBERG, NOES: NONE ABSTAINED: NONE ABSENT: NONE ATTEST: "CITY CLE~ LANE, RITCHEY, SCHLENDORF, SHIMANSKY MAYOR APPROVED AS TO FORM: AGRFi~.MI~.NT FOR ASSIGNMENT OF COMB~ ROAD PROGRAM (CRP) FUNDS This Agreement is made and entered into this _~day of ~~ , 1991, by and between SANTA CLARA COUNTY TRAFFIC AUTHORITY, h~ce?a~er referred to as "AUTHORITY" and the TOWN OF DANVILLE, hereinafter referred to as "TOWN." WITNESSETH: WHE~, TOWN wishes to assign $570,000 of its allocation of CRP funds to AUTHORITY in exchange for eighty percent (80%) of that amount in funds that may be used for any transportation related purpose; WHEREAS, the AUTHORITY wishes to accept said assignment for use on a transportation project which qualifies for CRP funding; WHE~ the CRP funds are discounted to AUTHORITY because of expenditure restrictions and increased administrative costs associated with using said funds; WHEREAS Title 23, Section 104 of the United States Code provides apportionment for Federal-aid Systems; WHEREAS Section 137 of the 1987 Surface Transportation and Uniform Relocation Assistance Act established the Combined Road Plan Demonstration Program (CRP); WHEREAS CALTRANS elected to participate in said CRP program as per agreement with the Federal Highway Administration (FHWA) dated May 30, 1989; WHEREAS said CRP agreement combines all Urban, Secondary, and non-primary bridge funds into a single CRP fund pool; WHE~ Chapter 647, State Statutes, 1990, authorizes the enactment of the CRP and its operating 9olicy and procedures; WHEREAS said operating policy and procedures allow CRP funds to be transferred between local agencies with the approval of the appropriate local officials; WHERF_~S AUTHORITY and TOWN consider this assignment and exchange as fair and equitable treatment under the CRP program; NOW, THEREFORE, it is mutually agreed as follows: 1. TOWN agrees to transfer $570,000 of its CRP fund apportionment to the AUTHORITY; , . AUTHORITY agrees to transfer $456,000 to TOXVN within 30 days of notification of actual transfer of the funds Jn Item 1 by Caltrans; and TOWN agrees to use the received funds from AUTHORITY for transportation related purposes.
