HomeMy WebLinkAbout105-91RESOLUTION NO. 105-91 A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF DANVILLE IN THE MATTER OF SUPPORTING STATE LEGISLATION TO PROTECT CITIZENS FROM UNFAIR CABLE TELEVISION BILL PRACTICES WHERF~S, the Town of Danville has received complaints from cable television subscribers about the assessment of late fees prior to the last day of the period covered by the charges and the disconnection of service without sufficient notice; and WHEREAS, the Cable Communications Act of 1984 gives local government the authority to establish customer service requirements in accordance with their franchise agreement; and WHEREAS, the Town of Danville does not have the flexibility to revise its current cable television franchise agreement to protect cable TV subscribers from these unfair billing practices; and WHEREAS, these consumer protection issues are important to cable TV subscribers throughout California; now, therefore, BE IT RESOLVED, by the Town Council of the Town of Danville that the Town Council hereby encourages the state to broaden the consumer protection provisions of AB 821 to proxide that late fees cannot be assessed until 10 days after the end of the period covered by the charges and that service cannot be disconnected for nonpayment unless the subscriber has received a written notice of a proposed disconnection of service no less than 10 days before the disconnection date, and be it FURTHER RESOLVED, the Town Council hereby authorizes the Town Manager to forward a copy of this Resolution to State Legislators and the Contra Costa delegation.
