HomeMy WebLinkAbout099-91 RESOLUTION NO. 99-91 AUTHORIZING THE PREPARATION OF A GENERAL PLAN AMENDMENT STUDY FOR THE 77-PARCEL 356-ACRE LAWRENCE ROAD AREA (GPA 91-4) WHEREAS, on September 12, 1990, application was made by East Bay Municipal Utility District (EBMUD) to the Contra Costa County Local Agency Formation Commission (LAFCo) for a proposed annexation of lands in the Lawrence Road area to said district; and WHEREAS, the reasons for the application were as follows: a) EBMUD is the water supplier for the area and has facilities that could be extended to serve the area, b) The area is predominantly developed in a rural residential use, c) EBMUD had received input from the affected landowners and the Town of Danville expressing the desire for annexation, d) EBMUD determined that annexation of the area would facilitate the operation of a public utility and be of advantage to the community; and WHEREAS, The Town Council of the Town of Danville indicated their support for the annexation by their passage of Resolution No. 38-90 which stated the following reasons for supporting the annexation: a) The area has been developed in rural residential densities for many years and is directly adjacent to the existing Town boundary, b) The annexation was promulgated by a petition signed by a majority of the landowners in the Lawrence Road area, c) Proposed surrounding development (Dougherty and Tassajara Valleys) will not occur under the Town's control and could result in adverse impacts to the Town. The Town prefers to have control over the future of Lawrence Road, in particular for use of that road in the ultimate circulation system for the Dougherty and Tassajara Valleys, PAGE NO. I RESOLUTION NO. 99-91 d) With the annexation, the Town and the landowners in the area can work jointly toward a solution of the problems associated with the lack of potable water; and WHEREAS, in the manner prescribed by law, LAFCO and the Town of Danville prepared the appropriate environmental documentation, conducted duly noticed hearings and passed the appropriate resolutions to provide for the annexation of the 77-parcel 356-acre area into the Town of Danville (with the area also being annexed into the service boundaries of EBMUD and reorganized to be wholly in the service boundaries of San Ramon Valley Fire Protection District); and WHEREAS, with their adoption of Resolution No. 32-91, the Town Council acknowledged the need to provide a reliable source of domestic water to the residents of the Lawrence Road area; and WHEREAS, there is recognition that the cost of provision of water service is relatively high, as a function of the parcels served; and WHEREAS, the Town, in its commitment to work with the Lawrence Road residents to achieve the necessary infrastructure to provide domestic water, has indicated a willingness to prepare a general plan amendment study for the area to consider allowing increased densities in the context of the rural residential pattern currently in place; and WHERFakS, Sections 65350 et. seq. of the Government Code of the State of California prescribe the procedure for adopting and amending the Town's General Plan; and WHEREAS, the Town of Danville requires Town Council authorization prior to the preparation of General Plan Amendment Studies; and WHEREAS, the Town Council did consider the request for authorization/Scope of Study of the Lawrence Road General Plan Amendment Study a public hearing on May 21, 1991; and WHEREAS, a staff report was submitted recommending that the Town Council take the following actions; PAGE NO. 2 RESOLUTION NO. 99-91 1. Authorize the preparation of a General Plan Amendment Study. 0 Direct staff to return in June of 1991 as part of the budget hearings to request appropriations for the consultant work needed in conjunction with the Study. . Authorize approximately 350 hours of staff time to be dedicated to the General Plan Amendment Study. WHEREAS, the Town Council hereby finds that a General Plan Amendment Study of the Lawrence Road area is appropriate and is in the public interest for the following reasons: lo The Town has made a commitment to work with the Lawrence Road residents to achieve the infrastructure improvements necessary to extend domestic water service to the area. 0 The goals and policies of the draft 1990 Housing Element Update and the Danville 2005 General Plan indicate that additional sites should be considered for residential use. . The proposed area, with the provision of water - and possibly other urban services, appears to have a potential for increased residential development. . The area includes properties that may be under-utilized if additional services can be extended to the area. 0 Increased urbanization in vicinity of the study area has had a negative impact on existing rural ranchette/low density single family residential land uses. WHEREAS, the Town Council did hear and consider all reports, recommendations and testimony submitted in writing and presented at the hearing; NOW, THEREFORE, BE IT RESOLVED THAT the Town Council of the Town of Danville concurs with the recommendations of staff as outlined in the May 21, 1991 Staff report prepared for this matter and authorizes the preparation of a General Plan Amendment Study as indicated above; and PAGE NO. 3 RESOLUTION NO. 99-91 BE IT FURTHER RESOLVED THAT, in authorizing the Lawrence Road General Plan Amendment Study, the Town Council is not indicating any predisposition to approve any particular mix of land use designations through the requested General Plan Amendment.
