HomeMy WebLinkAbout078-91RESOLUTION NO. 78-91 AUTHORIZING THE PREPARATION OF A GENERAL PLAN AMENDMENT STUDY FoR THE EL CERRO BOULEVARD/LA GONDA WAY STUDY AREA (GPA 91-2) AND APPROPRIATE NECESSARY FUNDS WHE~, Sections 65350 et. seq. of the Government Code of the State of California prescribe the procedure for adopting and amending the Town's General Plan; and WHEREAS, on May 5, 1986 the Danville Town Council adopted General Plan Amendment (GPA 84-3) for the El Cerro General Plan Study, resulting in an amendment of General Plan land uses in the study area; and WHEREAS, on October 5, 1987 the Danville Town Council adopted the Danville 2005 General Plan for the Town of Danville; and WHEREAS, due to recent land use changes, market conditions and the identified need to provide additional affordable housing within the Town of Danville, the Danville Town Council directed staff to develop a scope of study for an area-wide General Plan Amendment Study of the E1 Cerro/La Gonda Way; and WHEREAS, the Town of Danville requires Town Council authorization prior to the preparation of General Plan Amendment Studies; and WHEREAS, the Town Council did consider the request for authorization/scope of study of an El Cerro/La Gonda Way General Plan Amendment Study during a public hearing on April 16, 1991; and WHEREAS, a staff report was submitted recommending that the Town Council take the following actions; 1. Authorize the preparation of a General Plan Amendment Study. o Authorize staff to hire consultants necessary to complete a traffic study, an office market study, a market study reviewing potential multiple family residential uses, and a schematic land plan for the Valley View Court/Offenhartz/Flynn properties (with a collective not-to-exceed cost of $29,000). PAGE 1 OF RESOLUTION 78-91 . Authorize approximately 600 hours of staff time to be dedicated to the General Plan Amendment Study. WHEREAS, the Town Council hereby finds that a General Plan Amendment Study of the El Cerro/La Gonda Area is appropriate and is in the public interest for the following reasons: . Since the approval of GPA 84-3 on May 5, 1986, there have been several land use changes in the area. . The office market has softened, resulting in a reduced demand for office space in Danville and in the Bay Area Region in general. . The goals and policies of the draft 1990 Housing Element Update and the Danville 2005 General Plan recommend that additional sites be considered for multiple family residential use. . The proposed Study Area appears to be appropriately situated for multiple family residential development because of its close proximity to the 1-680 Freeway and to needed services located in Downtown Danville. . The Study Area includes several properties that would appear to be under- utilized due to inappropriate land use designations. . Increased urbanization in the study area (including noise generated from the 1-680 Freeway, and increased traffic and noise generated by the future E1 Cerro Boulevard extension) has a negative impact on existing low density single family residential land uses. WHEREAS, the Town Council discussed the merits and need for a multifamily residential market study and determined that a market study would be appropriate to assure any proposed land use designation changes afford receiving properties comparable value to existing land use designations; and WHEREAS, the work study plan as outlined in the April 16, 1991 Staff Report shall be supplemented with additional input from affected property owners and residents at neighborhood meetings prior to staff proposing any specific land use changes; and WHEREAS, the Town Council did hear and consider all reports, recommendations and testimony submitted in writing and presented at the hearing; NOW, THEREFORE, BE IT RESOLVED THAT the Town Council of the Town of Danville concurs with the recommendations of staff as outlined in the April 16, 1991 Staff report prepared for this matter and authorizes the preparation of a General Plan PAGE 2 OF RESOLUTION 78-91 Amendment Study as indicated above; and BE IT FURTHER RESOLVED THAT, $29,000 be appropriated from the Excess Revenue Over Expenditures in the General Fund; and BE IT FURTHER RESOLVED THAT, the Town Council of the Town of Danville directs staff to return to the Council, as part of the General Plan Amendment Study, with a proposal for a reimbursement formula to allow the Town to recoup some, or all, of the public funds expended in conjunction with the study; and BE IT FURTHER RESOLVED THAT, in authorizing the above mentioned General Plan Amendment Study, the Town Council is not indicating any predisposition to approve the requested General Plan Amendment.
