HomeMy WebLinkAbout077-91RESOLUTION No. 77-91 APPROVING GPA 91-01 AMENDING THE GENERAL PLAN MAP BY ADDING PROPERTIES LOCATED ON THE WEST SIDE OF LAWRENCE ROAD AND DESIGNATING SAID PROPERTIES WITH A RURAL RESIDENTIAL LAND USE DESIGNATION WHEREAS, at the request of affected property owners, in conjunction with 30 parcels comprising 149 +/- acres located to the west of Lawrence Road previously General Planned and Prezoned by the Town of Danville, the subject 159 +/- acre area located on the east side of Lawrence Road has been annexed into the Town of Danville; and WHEREAS, the General Plan amendment is necessary to provide the area with a proper regulatory land use designation; and WHERF~S, the subject area is located on the east side of Lawrence Road, south of Camino Tassajara, approximately 1/2 mile east of the intersection of Camino Tassajara and Crow Canyon Road (APN: 206-140-002, 003, 006, 009 - 012, 015, 017 - 026 and 700 - 206-160-004, 006 - 008, 010 - 014, 016, 017, 019 and 020 -- 206-170-001, 004 - 006, and 008 - 011; and WHEREAS, the Planning Commission did review and recommend approval of the project at a noticed public hearing on April 9, 1991; and WHEREAS, an administrative staff report was submitted recommending designation of the area to Rural Residential land use designation pursuant to the Danville 2005 General Plan; and WHEREAS, the proposed land use designation is consistent with existing Contra Costa County land use restrictions in the area; and WHEREAS, a Negative Declaration of Environmental Significance has been prepared for the project indicating that, because the proposed General Plan and Zoning classifications will not intensify the allowable land uses in the area, no significant environmental impacts are anticipated to be associated with the project; and WHEREAS, the public notice of this action was given in all respects as required by law; and WHEREAS, the Town Council did hear and consider all reports, recommendations, and testimony submitted in writing and presented at the hearing; NOW THEREFORE, BE IT RESOLVED THAT the Town Council of the Town of Danville PAGE I OF RESOLUTION NO. 77-91 "x makes the following findings in support of the adoption of the Negative Declaration of Environmental Significance: . The Negative Declaration prepared, fully and adequately addresses potential environmental impacts associated with this action, satisfying the requirements of the California Environmental Quality Act (CEQA). . On the basis of the Initial Study of Environmental Impacts, there is no evidence that the project will have a significant effect on the environment. , There is no evidence before the Town that the proposed project will have any potential for adverse effect on wildlife resources. BE IT FURTHER RESOLVED THAT the Town Council of the Town of Danville adopts the Negative Declaration of Environmental Significance and approves General Plan Amendment GPA 91-01 and makes the following findings in support of their approval of the General Plan Amendment: . The proposed project is consistent with comprehensive goals contained within the Danville 2005 General Plan. . The General Plan Amendment will not adversely affect the preservation of present aesthetics and other community qualities. . The General Plan Amendment will not adversely affect the Town's ability to maintain high-quality public facilities and services. o The General Plan Amendment will not adversely affect the quality of life within existing developed areas of the community. 0 The General Plan Amendment will not adversely affect the harmony between Danville's development and it's physical setting.
