RESOLUTION NO. 76 - 91
AMENDED
IN OPPOSITION TO SB144, WHICH WOULD PROHIBIT THE UTILIZATION OF
PUBLIC FUNDS TOWARD THE DEVELOPMENT OR CONSTRUCTION OF THE MID-
STATE TOLLWAY
WHEREAS, the State of California has enacted AB680 which allows for the construction of
demonstration toll road facilities within California; and
WHEREAS, the Mid-State Tollway has been designated as one of the demonstration projects;
and
WHEREAS, the Mid-State Tollway would have substantial impacts on Tri-Valley circulation; and
WHERFa~, public funds generated within the Town of Danville could potentially be utilized for
toll road financing under the current legislation; and
WHEREAS, Senate Bill 144 would prohibit the utilization of public funds for the Mid-State
Tollway;
WHEREAS, a public/private partnership can be beneficial for the construction of roadway
improvements;
WHE~, jurisdictions within East Contra Costa County wish to utilize development fees to
partially finance the Mid-State Tollway; now, therefore, be it
RESOLVED that the Town Council of the Town of Danville opposes Senate Bill 144 and thereby
expresses its support for the limited use of public funds toward the development or
construction of the Mid-State Tollway. This support is based on the following conditions:

That the use of public funds be limited to those instances where the local
jurisdiction desires to use locally-generated public funds for the Tollway.
0
That the use of tipping fees be limited to the amount of fees attributable to the solid
waste transportation benefits of the Tollway.

That regional transportation fees collected within Danville or the Tri-Valley not be
utilized for the Tollway.

That no fees (other than tipping fees) collected within Danville be utilized for the
Tollway.

That the total amount of public funds for the Tollway bt. Axed at the outset of the
project with a prohibition on increases to this amount.
That the public funding sources for the Tollway be specified at the outset of the
project with a prohibition on additional public funding sources.
APPROVED by the Town Council of the Town of Danville at a Regular Meeting held on Tuesday,
June 18, 1991 by the following vote:
AYES: Ritchey, Schlendorf, Shimansky
NOES: Greenberg, Lane
ABSTAIN: None
ABSENT: None

A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF DANVILLE IN SUPPORT
OF SB144, WHICH WOULD PROHIBIT THE UTILIZATION OF PUBLIC FUNDS TOWARD
THE DEVELOPMENT OR CONSTRUCTION OF THE MID-STATE TOLLWAY
WHEREAS, the State of California has enacted AB680 which allows for the construction of
demonstration toll road facilities within California; and
WHEREAS, the Mid-State Tollway has been designated as one of the demonstration projects;
and
WHERFa~, the Mid-State Tollway would have substantial impacts on Tri-Valley circulation; and
WHE~, AB680 states that the toll roads would be privately funded; and
WHE~, public funds generated within the Town of Danville cotfid potentially be utilized for
toll road financing under the current legislation; and
WHEREAS, Senate Bill 144 would prohibit the utilization of public funds for the Mid-State
Tollway;
NOW, THEREFORE, BE IT RESOLVED that the Town Council of the Town of Danville
supports Senate Bill 144 and thereby expresses its opposition to the use of public funds toward
the development or construction of the Mid-State Tollway. The Town Council hereby authorizes
the Mayor of the Town of Danville to present this position at the next meeting of the Tri-Valley
Transportation Council.

April 16, 1991 by the following vote:
