DENYING A ONE YEAR TIME EXTENSION OF DANVILLE INN
(DP 89-30)
WHERF~S, a development plan for the Danville Inn (DP 89-30) was approved by Town Council
on October 19, 1987; and
WI-IERF~S, in June 1989, the applicant requested removal of the exterior brick veneer above
the first story and project phasing; and
WHEREAS, upon approval of the exterior modification, Town Council included a Condition
of Approval requiring that the project be under construction by October 18, 1990; and
WHEREAS, Solo Patel of Shilo Investments requested a one year extension of the Danville Inn
(DP 89-30) project on October 18, 1990 to complete the building permit application process;
and
WHERF~S, the Danville Inn is a 150 room hotel and the applicant has been working with the
Design Review Board and staff for over a year to complete a building permit application; and
WHEREAS, the applicant has failed to submit full and complete plans for plan checking in a
timely manner; and
WHERF_.AS, the project is located at 1501 Crow Canyon Place; and
WHEREAS, the Town Council of the Town of Danville hereby finds that:
1. The applicant has failed to obtain a building permit for the proposed 150 room hotel
by the time limits established by law;
2. Despite the fact that modifications to the project were approved to reduce costs, the
applicant to date has not demonstrated that he has secured financing for the project;
3. Since the original approval of the project in 1987, additional hotels have been built
within the market area for this project apparently diminishing the need for the project;
4. It appears that hotel vacancy rates in the San Ramon Valley have significantly
increased since the original approval of the project;
5. The applicant will not be able to complete construction of the project within two and
one-half years from the effective date of the zoning change and original development
plan approval on October 19, 1987 per ordinance requirements (Article 84-66.1406);
6. The applicant has failed to commence construction of the project within one year of
the Final Development Plan approval or amendment thereto according to the
requirements stated in the Planned Unit Development Ordinance (Article 84-66.16(2) (c)),
and has thereby failed to show good cause for extension of the development plan; now,
therefore,
BE IT RESOLVED by the Town Council of the Town of Danville, that the application by Shilo
Investments for a one year extension of time within which to commence construction of the
Danville Inn project (DP 89-30), is hereby denied.
APPROVED by the Danville Town Council at a Regular Meeting on February 19, 1991, by the
following vote:
