HomeMy WebLinkAbout046-91RESOLUTION NO. 46-91 AWARDING CONTRACT FOR THE CHILD CARE CENTER CONTRACT TO GEN-CON, INC. WHEREAS, the Town Council has previously approved the Child Care Construction Project; and WHEREAS, the City Clerk of this Town did, in open session on the thirteenth day of February, 1991, publicly open and read aloud the sealed bids received as required by law; and WHEREAS, RGM and Associates was the low bidder on such project with a bid of $225,000; and WHEREAS, Gen-Con, Inc. was the second-lowest bidder, with a bid of $229,445; and WHEREAS, subsequent to the opening of such bids, RGM and Associates notified the Town that it had made an error on its bid and requested relief therefrom; and WHEREAS, the Town is prepared to grant such relief; and WHEREAS, the Chief Building Official has recommended adoption of a resolution awarding a contract for the project to Gen-Con, Inc., the next-lowest bidder; and WHEREAS, the Town Council has previously budgeted $420,000 for the total project; NOW, THEREFORE BE IT RESOLVED by the Town Council of the Town of Danville, that the Town Manager be, and hereby is authorized to execute on behalf of the Town, the Child Care Center Project contract with Gen-Con, Inc., together with such changes as may hereafter become necessary, provided such changes do not materially increase the Town's obligations thereunder; and BE IT FURTHER RESOLVED by the Town Council of the Town of Danville, that the City Clerk shall within five days of the adoption of this resolution, transmit an extract of public works contract award to the Department of Industrial Relations, Division of Apprenticeship Standards, P.O. Box 603, San Francisco, California 94101. Should a finding of any discrepancy regarding the ratio of apprentices to journeymen be made, the Town shall notify the Division of Apprenticeship Standards of such findings; and asrg1264 BE IT FURTHER RESOLVED that RGM and Associates is hereby relieved of its obligation to perform under such contract, and the City Clerk is hereby directed to return such firm's bid bond.
