HomeMy WebLinkAbout039-91RESOLUTION NO. 39-91 REFUSING TO PAY FEES CHARGED BY CONTRA COSTA COUNTY PURSUANT TO SENATE BILL 2557 WHERF~S, Senate Bill 2557 (Chapter 466, 1988-1989 Regular Legislative Session) added Article 12 of Chapter 2 of Division 3 of Title 3 of the California Government Code, Sections 29550 et seq.; and WHEREAS, Senate Bill 2557 purports to authorize county governments to impose fees on cities and other specified local government entities for reimbursement of certain county expenses incurred in the performance of certain county duties; and WHEREAS, on January 15, 1991, Contra Costa County adopted its Resolution No. 90-822, which purportedly implements the provisions of Senate Bill 2557; and WHERFAS, substantial questions have arisen regarding the legality and equity of both Senate Bill 2557 and Contra Costa County Resolution No. 90-822; and WHEREAS, statewide and local efforts are currently underway to, among other things, legislatively repeal or amend Senate Bill 2557, challenge the legality of Senate Bill 2557, and challenge the legality of Contra Costa County Resolution No. 90-822; and WHEREAS, the Town Council believes that Senate Bill 2557 and County Resolution No. 90-822 are inequitable in that they seek to shift the burden of a state budget crisis onto local entities which did not contribute to the crisis, and which are least able to bear the burden of such shift; now, therefore, BE IT RESOLVED, by the Town Council of the Town of Danville that the Town Manager is hereby authorized and directed to refuse to pay any invoices submitted to the Town by Contra Costa County pursuant to the County's Resolution No. 90-822.
