HomeMy WebLinkAbout022-91RESOLUTION NO. 22-91 ADOPTING A NEGATIVE DECLARATION OF ENVIRONMENTAL SIGNIFICANCE FOR THE 1990 UPDATE OF THE DANVILLE HOUSING ELEMENT AND REFERRING THE ELEMENT TO THE STATE OF CALIFORNIA DEPARTMENT OF HOUSING AND COMMUNITY DEVELOPMENT FOR REVIEW AND COMMENT WHEREAS, pursuant to Government Code Section 65580 et seq., the Town of Danville has prepared a Housing Element Update for the Danville 2005 General Plan; and WHEREAS, the Danville Planning Commission and Town Council held workshops on June 5, 1990 and June 12, 1990 respectively to review and comment on the draft program and policy options for the Housing Element Update; and WHERF~S, pursuant to Government Code Sections 65351 and 65583(c)(6), a public workshop was held on September 27, 1990 to obtain citizen input regarding the circulation draft of the 1990 Housing Element Update; and WHEREAS, the comments of the public who attended were considered in the preparation of the draft 1990 Housing Element Update; and WHEREAS, pursuant to the provisions of State Planning and Zoning Law, it is the function and duty of the Planning Commission of the Town of Danville to review and recommend action on proposed amendments to the Town's General Plan and the individual Elements composing the General Plan; and WHEREAS, the California Environmental Quality Act (CEQA) requires that certain projects be reviewed for potential environmental impact and that environmental documents be prepared; and WHEREAS, a Negative Declaration of Environmental Significance had been prepared by the Danville Planning Division; and WHEREAS, an Environmental Impact Report was prepared for the Danville 2005 General Plan and certified as complete on October 5, 1987; and WHEREAS, the referenced Environmental Impact Report addressed impacts of future development of the Town of Danville (which exceeds the anticipated impacts resulting from implementation of the Housing Element Update); and PAGE 1 OF RESOLUTION 22-91 WHERFAS, the projected increase in the Town's dwelling unit and population totals, and programs proposed in the draft 1990 Housing Element Update do not raise any new significant environmental issues which were not addressed in the Danville 2005 General Plan Environmental Impact Report; and WHEREAS, the Planning Commission of the Town of Danville did review the Housing Element Update at public hearings on October 23, 1990 and December 11, 1990: and WHEREAS, notice of the Planning Commission hearing was in all respects as required by law; and WHEREAS, the Planning Commission did hear and consider all reports, recommendations, and testimony submitted in writing and presented at the hearing; WHEREAS, the Planning Commission approved Resolution No. 90-57, recommending the Town Council adopt the Negative Declaration of Environmental Significance, review the draft 1990 Housing Element Update and refer the document to the State Department of Housing and Community Development for review and comment; and WHEREAS, the Town Council did review and consider the draft 1990 Housing Element Update at a duly noticed public hearing on January 28, 1991 and March 5, 1991, and did hear and consider all recommendations, and testimony submitted in writing and presented at the meetings; and WHEREAS, the Town Council did amend the Planning Commission's recommendation regarding Policy 2.13 to utilize the existing Planning Commission / Town Council framework (using either the existing Planning and Transportation Council Subcommittee or a new committee composed of two Planning Commissioners and two Town Council members); WHEREAS, the Town Council did include an additional policy, Policy 6.3 to request exemptions or reductions in development fees charged by other agencies upon affordable housing projects; and WHEREAS, the Town Council did amend the draft Element in context as reflected in the draft included in Exhibit B of the March 5, 1991 Administrative Report; and WHEREAS, the Town Council did further amend and refine the draft Element in PAGE 2 OF RESOLUTION 22-91 context during the March 5~91 public hearing and those chan~, are reflected in the Final Draft dated March 5, 1991; and NOW, THEREFORE, BE IT RESOLVED THAT the Danville Town Council finds that: o The adoption of the 1990 Housing Element Update will not have any significant environmental impacts and is consistent with the information in the Final Environmental Impact Report prepared for the Danville 2005 General Plan. o The Negative Declaration has been prepared and processed in accordance with State environmental law and guidelines and is adequate and complete, BE IT FURTHER RESOLVED THAT the Danville Town Council adopts the Negative Declaration of Environmental Significance and refers the draft 1990 Housing Element Update (contained as Exhibit B to the March 5, 1991 Administrative Staff Report) to the State of California Department of Housing and Community Development for review and comment.
