APPROVING THE MILLS ACT CONTRACT FORMAT WHEREAS, several unique historic structures and sites exist within the Town of Danville; and WHEREAS, the Town of Danville has documented the importance of historic structures and sites in the Town's General Plan; and WHEREAS, the Town of Danville adopted a Historic Preservation Ordinance on May 15, 1989 (Ordinance No. 89-8); and WHEREAS, the Historic Preservation Ordinance includes incentives encouraging historic property owners to designate their property as a Heritage Resource (Section 8-5805); and WHE~, on August 9, 1990 the Heritage Resource Commission approved Resolution No. 90-3 recommending that the Town Council approve the Draft Mills Act Contract. WHEREAS, on October 11, 1990 the Heritage Resource Commission approved a detailed description of incentives to be offered to historic property owners to encourage Heritage Resource designation of their properties; and WHEREAS, the Heritage Resource Commission recommends that Town Council take action to approve the detailed description of incentives offered to historic property owners; and WHEREAS, the Town Council did hear and consider all said reports, recommendations and testimony as herein set forth; BE IT RESOLVED, the Town Council of the Town of Danville that the Town Council hereby finds that: . Ordinance No. 89-8, Section 8-5805 - Incentives (Historic Preservation Ordinance), lists "a reduction in property taxes" as an incentive to eligible property owner(s) to encourage their participation in the Heritage Resource preservation program. 0 The State of California enacted the Mills Act as an incentive to preserve historic properties by reducing property taxes. . The relatively minor fiscal impact resulting from a reduction of property taxes collected by the Town is outweighed by the public benefit of preserving Danville's Heritage Resources. . Town Council directed Staff to provide a detailed description of incentives that may be offered to historic property owners to encourage designation of historic properties.
