HomeMy WebLinkAbout015-91RESOLUTION NO. 15-91 APPROVING A CHILI) CARE WORK PROGRAM INCLUDING THE ESTABLISHMENT OF DEVELOPMENT STANDARDS FOR CHILD CARE FACILITIES LOCATED wnlqlN RESIDENTIAL NEIGHBORHOODS WHEREAS, the Town Council of the Town of Danville has determined that the provision of quality child care is a high priority issue; and, WHEREAS, a child care study was completed in June, 1988 to assess existing and future child care needs; and WHEREAS, an update to the survey may be warranted to reevaluate the existing and future needs; and WHEREAS, the Town Council has previously heard opposition to Land Use Permit applications where the integration of child care facilities in converted residences within residential neighborhoods was proposed; and WHEREAS, the Town of Danville is committed to protect the quality of life in existing residential neighborhoods by preserving neighborhoods and authorizing the incorporation of non-residential uses into neighborhoods only where they can be demonstrated to be effectively integrated into the neighborhood and where the land use activity can be found to be compatible with the residential character of the neighborhood; and WHEREAS, establishment of development standards for child care facilities proposed in residential neighborhoods may be warranted; and WHEREAS, the Town Council did consider the Draft Work Plan contained within the Town Council Report of January 15, 1991, and did hear and consider all recommendations, and testimony submitted in writing and presented at the meeting; and WHEREAS, the Town Council did make revisions to the Draft Work Program as submitted; and WHEREAS, the revisions have been incorporated in the attached Work Program; NOW, THEREFORE, BE IT RESOLVED, by the Town Council of the Town of Danville that the Town Council hereby approves the Child Care Work Program (see Attachment A); PAGE 1 OF RESOLUTION NO. 15-91 APPROVED by the Danville Town Council at a Regular Meeting on January 15, 1991, by the following vote: AYES: NOES: ABSTAINED: ABSENT: GREENBERG, LANE, RITCHEY, SCHLENDORF, SHIMANSKY MAYOR ATTEST: CITY CLERK apmm22 APPROVED AS TO FORM: .,2 PAGE I OF RESOLUTION NO. 15-91 ATTACHMENT A CHILD CARE ISSUES - DRAFT WORK PLAN January 15, 1991 . Develop information of established practices at existing facilities: There are currently 10 large family day care facilities within the Town limits (i.e., facilities registered to care for 7-12 children). There are currently 14 commercial child care facilities operating in Town (generally ranging from 20 to 108 children, operating out of converted residences, churches and/or build-to-suit facilities) and three school age child care facilities at local elementary schools. Two additional sites, Montair and Green Valley School, are slated for January 1991 opening. Possible tasks in this area are prioritized in a high to low rating system. a. Update needs survey for child care. The needs assessment should identify the number of current day care openings in Danville, the number of openings in facilities in close proximity to Danville, and the number of Danville residents vs. residents from other jurisdictions being served by Danville facilites (high) Time Commitment: 30 hours/Completion in 1 - 2 months. b. Survey neighbors to check impacts of operating facilities. A draft survey has been prepared. Consider the most appropriate method to obtain the most accurate response. (i.e. physical contact through door-to-door canvassing, telephone survey. (high) Time Commitment: 8 - 12 hours per site depending on method and survey. C. Additional follow-up tasks which may be generated by the survey. If negative responses are received, what will staffs position be? Time Commitment: Follow up work - I - 2 hrs. per site. Secure traffic counts of number and spacing of trips for drop-offs / pick-ups (med) Time Commitment: 6 hours per site. 0 Take proactive/supportive role on the development of new public and semi-public child care facilities: Encouragement for the development of new facilities can be provided through advance identification available facilities that are not utilized, or are under utilized, and through access to information. Possible tasks in this area are prioritized in a high to low rating system. a. bo c. Identify potential private/public sites (complete): - Peace Lutheran Church (1027 Diablo Road) - Rolling Hills Church (1565 Green Valley Road) - Magee Ranch Park Develop handouts outlining the review process/regulations for use by potential operators (high) Time Commitment: 15 - 20 hours. Provide on-site inspection services (Building/Fire) to potential operators (med). Time Commitment: 15 - 30 hours. . Take proactive role in finding new sites: Through the development review process, and through utilization of funding generated through the Child Care Ordinance, the Town has an opportunity to take a proactive / supportive role in the development of new facilities. a. Identify potential sites (high). Time Commitment: A list is included below. This task is generally complete. Charlutte Wood School Site Peace Lutheran Church - 1028 Diablo Road Utilize the development review process to encourage/require development of new facilities at identified potential sites. (high) Time Commitment: Efforts are ongoing for the sites designated in a. above which have an asterisk. This work is ongoing and an amount of time cannot be accurately estimated. Develop a long-term strategy/plan for the utilization of the funding generated through the Child care Ordinance. (high) Time Commitment: 15 - 30 hours. Establish list / make contact with possible commercial operators. This task shall be pursued only if a definite shortage of the day care spaces has been identified in the update of the needs assessment. (med) Time Commitment: 10 - 15 hours. . Establish policies and development criteria for day care facilities in existing residential neighborhoods. In response to the recent vocal opposition to proposed facilities in converted residential units on the west side of Town, consideration of changes in land use regulations pertaining to operation of child care facilities within residential areas may be warranted. The "changes" that could result from this review could range from a decision to prohibit future facilities, establish more refined/restrictive regulations or standards for future operations or maintain the zoning ordinance in it's current format. The steps involved with this analysis would include the following; a. Survey what other jurisdictions are doing. b. Review options through Planning and Transportation Sub-committee. c. Establish "Development Criteria"/Residential Day Care Policy Statement. d. Initiate review and comment through the Planning and Transportation Sub- committee, followed by Council review. A determination shall be made by Council if a Zoning Text Amendment is necessary. e. Implement changes coming out of the process. Time Commitment: 60 - 80 hours - 3 - 4 months to research and draft development criteria for review and comment. childcr.wrk 3
