HomeMy WebLinkAbout230-90RESOLUTION NO. 230-90 ACCEPTING THE REPORT AND ADOPTING THE RECOMMENDATIONS OF THE DANVILLE CREEKS SUBCOMMITTEE PERTAINING TO SPECIAL SUBMITTAL MATERIALS FOR DEVELOPMENT PROJECTS WHEREAS, the Town of Danville is vitally interested in the care and preservation of its natural resources among which are the creeks and their environs; and WHEREAS, the Town of Danville 2005 General Plan set comprehensive goals and policies for the preservation of creeks in Danville; and WHEREAS, the Parks & Leisure Services Commission recommended to Town Council that a Subcommittee be appointed to study creek issues; and WHEREAS, on May 1, 1990, Town Council appointed the Danville Creeks Subcommittee to develop standards and guidelines for new development proposals which contain or abut creeks in Danville; and WHEREAS, the Danville Creeks Subcommittee held four meetings in which creek issues were studied and recommendations formed; now, therefore, be it RESOLVED, by the Town Council of the Town of Danville that the Town Council hereby finds that the following Special Submittal Materials be required for new development proposals which contain or abut creeks in Danville: Special Submittal Materials le Hydraulic Calculations: The applicant must determine the potential creek flow at total build-out, and the creek's watershed during a one-hundred year storm. Using several creek sections, it must be determined whether the creek has the capacity within its banks to hold the flow levels generated from the above calculation. If it does not, the applicant must submit proposed creek modifications which are consistent with Town goals and policies, and acceptable to Flood Control. This will assure that the Town is aware of what will need to be done to the creek prior to scheduling the item for the public hearing. . Tree Survey: The applicant must submit a tree survey that identifies significant trees (all trees greater than six inches in diameter regardless of species) within the impacted zone. This survey must be accompanied by a tree protection plan that includes the measures to be taken to protect existing trees, assuring the trees will not be impacted by the proposed improvements. · Re-Vegetation Plan: The applicant must submit and agree to fund and implement a re-vegetation plan proposing improvements that enhance and/or repair the natural character of the creek· · Creek Cross Sections: The applicant must submit sufficient drawings to show all necessary sections of both existing and proposed conditions· These sections must include maintenance road locations, cross over locations or bridges· 0 Permits: The applicant must document all required parallel permits for stream bed alterations which have, or will be, secured from the Department of Fish and Game and the Army Corps of Engineers. . Tentative Map: The applicant must show all necessary structural setbacks and creek easements on the tentative map. (Where fee title for the creek Zone will be transferred to Flood Control, this area must be shown as a separate parcel; and be it FURTHER RESOLVED that the Town of Danville: l· Impose higher standards of environmental review by addressing potential environmental impacts early-on in the development process· · Direct staff to incorporate specific design standards for creek development into the Towns's standard development plans. · Direct staff to seek out imaginative solutions to creek designs and when applicable, incorporate into the Specific Submittal Materials and the Town's Standard Plans· Whenever possible, provide examples and approaches within the policy to give staff specific ideas for resolving issues· · Direct staff to develop a master agreement between the Flood Control District and the Town which specifies the rules for approval of plans as related to creek maintenance. 0 Direct staff to design a brochure to be given to developers when they inquire about development procedures which includes the goals, policies, special submittal materials and selected graphics for the preservation of creeks in Danville· · Direct staff to impose the Special Submittal Materials and the Design Standard Plans until July 1, 1991, after which the Creeks Subcommittee will be recalled and provided a report to include the following: So Review of the Special Submittal Materials and Standard Plans as they have been developed· b. Report on the test cases (estimated to be two to five projects) which have been subjected to the requirements. C. Recommendation to Town Council for adoption of final Special Submittal Materials and Standard Plans.
