A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF DANVILLE
APPROVING AMENDMENTS TO AGREEMENTS "B" & "C" WITH
EAST BAY REGIONAL PARK DISTRICT
WHEREAS, East Bay Regional Park District and the Town of Danville have previously entered into
cooperative funding Agreements "B" & "C" for the Iron Horse Trail; and
WHEREAS, East Bay Regional Park District has complied with all conditions of the original
Agreements "B" & "C"; and
WHERF~_S, East Bay Regional Park District has requested Town Council to approve amendments
to original Cooperative Funding Agreements "B" & "C" to accomplish the replacement of a
substandard pedestrian bridge on the Iron Horse Trail south of La Serena Avenue in Alamo; and
WHEREAS, the amendments proposed by East Bay Regional Park District are consistent with the
original agreements; and
WHEREAS, approval for the work proposed by the amendments has been obtained from the
Metropolitan Transportation Commission who administer all TDA grant funds; and
WHEREAS, funds are available to complete the proposed work from excesses in completed TDA
grants; and
WHEREAS, the work proposed by the amendments will be at no cost to the Town of Danville;
now, therefore,
BE IT RESOLVED, by the Town Council of the Town of Danville that the proposed amendments
are consistent with the Town's endeavor to upgrade the Iron Horse Trail; and be it
FURTHER RESOLVED, that the proposed amendments to Agreements "B" & "C" are hereby
approved and the City Clerk and Town Manager are hereby authorized and directed to execute
the same on behalf of the Town.

following vote:

COOPERATIVE FUNDING AGREEMENT FOR DEVELOPMENT OF
THE IRON HORSE TRAIL IN DANVILLE
This amendment is hereby made and agreed upon by the Town of
Danville, acting through the City Manager and by the East Bay
Regional Park District, acting through the General Manager
pursuant to the above identified project.
The Town and EBRPD, in mutual consideration of the promises made
herein and in the agreement in which this is an amendment, to
promise as follows:
That the above-mentioned agreement is amended as follows:
Construct a non-vehicle bridge to replace the old bridge over
"Rutherford" Creek south of La Serena Avenue in Alamo.

THE IRON HORSE TRAIL IN DANVILLE
This amendment is hereby made and agreed upon by the Town of
Danville, acting through the City Manager and by the East Bay
Regional Park District, acting through the General Manager
pursuant to the above identified project.
The Town and EBRPD, in mutual consideration of the promises made
herein and in the agreement in which this is an amendment, to
promise as follows:
That the above-mentioned agreement is amended as follows:
Use $17,315 from the EBMUD donation for construction of a non-
vehicle bridge to replace the old bridge over "Rutherford" Creek
south of La Serena Avenue in Alamo.
