HomeMy WebLinkAbout216-90RESOLUTION NO. 216-90 SUPPORTING GROWTH MANAGEMENT INITIATIVE MEASURE "F" (CONTRA COSTA GREENBELT INITIATIVE) APPEARING ON THE COUNTY-WIDE BALLOT FOR THE NOVEMBER 6, 1990 BALLOT WHEREAS, two growth management initiatives will appear on the County-wide ballot for the November 6, 1990 election; and WHEREAS, one of the two initiatives is identified as Measure "F" (Contra Costa Greenbelt Initiative) and is sponsored by the Greenbelt Alliance; and WHEREAS, the general provisions of Measure "F" are as follows: Measure "F,, (Contra Costa Greenbelt Initiative) - Effectively takes the County out of the development review process by requiring that all unincorporated areas within the County currently carrying the following land use designations; Agricultural Recreation, Commercial Recreation, Recreation, Agricultural Preserve, General Open Space, Agricultural Residential, and Interim Agricultural be redesignated to Open Space Agricultural (with a 320-acre minimum parcel size) or Agricultural Core (with a 40-acre minimum parcel size) land use designations. Permits / focuses continued urban development within the incorporated boundaries of the County; and WHEREAS, Measure "F" was placed on the ballot partly in response to the apparent lack of direction of the ongoing County General Plan update process in terms of growth management; and WHEREAS, at the September 6, 1990 Town Council meeting, the Council received a briefing from Town staff regarding the two growth management initiatives; and WHEREAS, at the direction of the Town Council, staff subsequently organized a special study session to allow expanded discussion and consideration of the merits of the two initiatives and the study session was conducted on October 10, 1990 and included presentations by representatives for each of the two initiatives; and PAGE I RESOLUTION 216-90 WHEREAS, the Town Council considered the merits of the two growth management initiatives at their meeting on October 16, 1990; and WHEREAS, said item was noticed in all respects as required by law (including a "courtesy" mailed notification to all Danville Home Owner Associations, locally active residential and commercial development firms and other interested parties); and WHEREAS, the Town Council did hear and consider all reports, recommendations, and testimony submitted in writing and presented at the hearing; and WHEREAS, passage and implementation of Measure "F" will not adversely affect the County's ability to meet housing demands for the fifteen year period from 1990 to 2005 (studies indicate the housing demand to be 77,100 dwelling units and that a total of 91,000 dwelling units could be established under the provisions of Measure "F' given existing general plan designations for the cities in Contra Costa County and the designations for the unincorporated urban areas that would be allowed to continue to develop under the provisions of the initiative); and WHEREAS, the provisions in Measure "F" to establish 40-acre and 320-acre minimum parcel sizes for agricultural lands will have a net positive effect in assuring the agricultural viability and productivity of these lands over the long run and is consistent with similar, progressive actions taken by other Bay Area Counties; and WHEREAS, the development pattern envisioned by Measure "F" will result in more centralized development resulting in a net long term reduction of up to 220,000 daily automobile trips then the less centralized development patterns that could result from implementation of the draft County General Plan and the provisions of Measure "C"; and WHEREAS, adoption of Measure "F" will ensure local control of urban development by prohibiting the County from authorizing development of existing unincorporated open space / agricultural lands inside a City's adopted sphere of influence; PAGE 2 RESOLUTION 216-90 NOW, THEREFORE, BE IT RESOLVED THAT the Town Council of the Town of Danville supports, and recommends passage and implementation of, Measure "F" (Contra Costa Greenbelt Initiative). APPROVED by the Danville Town Council at a Regular Meeting on October 16, 1990 by the following vote: AYES: GREENBERG, LANE, RITCHEY, SCHLENDORF, SHIMANSKY NOES: NONE ABSTAINED: NONE ABSENT: NONE ATTEST: ///~ CITY CLERK MAYOR CITY ATTORNEY resol.os P~GE 3 RESOLUTION 216-90 RESOLUTION NO. 206-90 A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF DANVILLE APPROVING THE SATISFACTORY COMPLETION OF IMPROVEMENTS AND ACCEPTING THE PUBLIC RIGHT-OF-WAYS AND EASEMENTS WITHIN DIABLO HIGHLANDS, SUBDIVISIONS NUMBER 6751, 6752, 6753 AND 6754 WHEREAS, Shapell Industries of Northern CA, Inc. is the Subdivider of said subdivision; and WHEREAS, Subdivider has requested the Town of Danville to accept said subdivision as complete; and WHEREAS, the City Engineer has advised that the improvements required as a condition of that subdivision agreement between the Town of Danville and said Subdivider have been satisfactorily completed; and WHEREAS, said subdivision lies within the corporate limits of the Town of Danville; and WHEREAS, it is now in the interests of the Town of Danville to accept those public improvements installed as public facilities for the benefit of, and use of, the general public; and WHEREAS, it is now in the interests of the Town of Danville to accept those public streets and easements on said subdivision map, for the benefit of, and use of, the general public; and WHEREAS, Town Council must act affirmatively in order for the subdivision to be accepted; now, therefore, BE IT RESOLVED, by the Town Council of the Town of Danville that the Town of Danville hereby accepts those public improvements installed as a condition of this Subdivision; and be it FURTHER RESOLVED, that the Town of Danville hereby accepts all public streets offered for the public benefit within this Subdivision; and be it FURTHER RESOLVED, that the Town of Danville hereby accepts all public drainage easements offered which convey drainage from public streets; and be it FURTHER RESOLVED, that the Town of Danville hereby accepts the landscape maintenance easements offered for the public benefit within this Subdivision; and be it FURTHER RESOLVED, that the Town staff is authorized and directed to release those sureties required as a condition of this Subdivision in accordance with the subdivision agreement and the Town Code. APPROVED by the Danville Town Council at a regular meeting on October 16, 1990, by the following vote: AYES: GREENBERG, LANE, NOES: NONE ABSTAINED: NONE ABSENT: NONE RITCHEY, SCHLENDORF, SHIMANSKY ATTEST: APPROVED AS TO FORM: CITY A~TORNEY RESOLUTION NO. 207-90 A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF DANVILLE ESTABLISHING THE SATISFACTORY COMPLETION OF IMPROVEMENTS WITHIN PARCEL MAP MS 858-88 WHEREAS, Etta Chiarello is the Subdivider of said subdivision; and WHEREAS, Subdivider has requested the Town of Danville to accept said subdivision as complete; and WHEREAS, the City Engineer has advised that the improvements required as a condition of that subdivision agreement between the Town of Danville and said subdivider have been satisfactorily completed; and WHEREAS, said subdivision lies within the corporate limits of Town of Danville; and WHEREAS, it is now in the interests of the Town of Danville to establish those private hnprovements as completed within said subdivision; and WHEREAS, it is in the interests of the Town of Danville to release those securities guaranteeing performance of the Subdivision Agreement; and WHEREAS, Town Council of the Town of Danville must act affirmatively in order for the subdivision to be accepted as complete; now, therefore, BE IT RESOLVED, by the Town Council of the Town of Danville that the private improvements required by said Subdivision Agreement are satisfactory; and be it FURTHER RESOLVED, that the Town staff is authorized and directed to release those securities required as a condition of this Subdivision in accordance with the Subdivision Agreement and the Town Code.
