HomeMy WebLinkAbout191-90RESOLUTION NO. 191-90 AUTHORIZING TOWN MANAGER TO EXECUTE A MEMORANDUM OF UNDERSTANDING WITH THE COMMUNITY SERVICES GROUP REGARDING THE PROVISION OF RECREATIONAL SERVICES WHEREAS, the Community Services Group ("CSG") is a California non- profit corporation which has provided community recreation programs and services in the San Ramon Valley for a number of years; and WHEREAS, such programs and services include, without limitation, a senior recreation program and newsletter, scheduling use of ball fields for various sports leagues and organizations, and aquatics; and WHEREAS, the Town Council of the Town of Danville desires to offer selected cultural, recreational and leisure services to the citizens of Danville, and has so provided in the Town of Danville's 1990-1992 budget; and WHEREAS, the Town Council desires to coordinate such programs and services with the CSG in order to avoid duplication and to develop a long-term plan for leisure services; and WHEREAS, the Town and CSG have prepared a Memorandum of Understanding ("MOU") to address these issues, which MOU provides for the payment of $86,000 by the Town of Danville to the CSG over a two-year period for the continuation of specified programs and services by CSG over such period; now, therefore, BE IT RESOLVED, by the Town Council of the Town of Danville that the Town Manager be, and hereby is authorized to execute, on behalf of the Town, a Memorandum of Understanding with the Community Services Group in the form as lodged with the City Clerk, together with such changes as may hereafter become necessary, provided such changes do not materially increase the obligations of the Town hereunder. PASSED, ADOPTED AND APPROVED by the Danville Town Council at a Regular Meeting held on September 4, 1990 by the following vote: AYES: NOES: NONE ABSENT: NONE ABSTAIN: NONE GREENBERG, LANE, RITCHEY, SCHLENDORF, SHIMANSKY ATTEST: ~~Ci y Cler~~ APPROVED AS TO FORM~ / City Attorney .J MEMORANDUM OF UNDERSTANDING TOWN OF DANVILLE SAN RAMON VALLEY COMMUNITY SERVICES GROUP This Memorandum of Understanding is entered into this ~/~ day of~ 1990 between the Town of Danville (Town) and the San Ramon Valley Cofnmfinity Services Group (Community Services Group), a California non-profit corporation. This Memorandum of Understanding is for a two-year period and is based on the following facts and circumstances: PURPOSE The Community Services Group has been the primary provider of community recreation programs and services in the San Ramon Valley for over twenty years. With the adoption of the 1990-92 Budget, the Town Council made the determination that the Town will begin to offer selected cultural and leisure services programs. It is the intention of the Town and the Community Services Group to work together to insure that program offerings are coordinated and that a smooth transition of programs and services be achieved. This agreement fulfills the needs of both the parties as follows: A parmership will be established between the Community Services Group and the Town. The Community Services Group will provide recreation programs and services for senior citizens until September 1, 1990. The Town will pay the Community Services Group $6,000 to manage the program, provide twenty hours per week of staff time and to continue special classes presently in session through September 1, 1990. The Town will publish the "Silver Streak" in September. The Town will enter into an agreement with the Sports Alliance for the scheduling of Town maintained sports field facilities and the collection of fees. Twenty percent of the fees collected will be retained by the Sports Alliance for their services. It is understood that the Sports Alliance will subcontract with the Community Services Group to administer the agreement and the master schedule for Town maintained sports field facilities. -1o The Community Services Group will continue to offer aquatics, sports leagues and programs for youth and adults at the same level of service which has been provided in previous seasons. The Town will not offer programs in the area of sports and aquatics and will provide $40,000 each year in support to the Community Services Group for Fiscal Year 90-91 and 91-92 to assist with the' provision of these services. The intent of this section is to minimize duplication in the provision of enrichment program and services. The Community Services Group currently offers enrichment programs and plans to continue to offer such programs. The Town contemplates provision of cultural services in all forms of visual and performing arts to include classes, performances and special events. .. It is in the best interest of the public that available monies be used efficiently and effectively and that the Town and Community Services Group not duplicate each other. During the term of this agreement, the Town and Community Services Group will provide course listings to each other at least six months in advance of when the courses are scheduled. Every attempt will be made to resolve the perceived duplication. If resolution is not achieved, either organization is free to offer the course in question provided that six months notice has been given. SPECIAL CONDITIONS Regular Meetings of the Town Staff and the Community Services Group The Town and the Community Services Group recognize the need for regular joint meetings for information sharing as well as to resolve policy questions that may arise. There shall be a joint meeting of staff representatives quarterly or more often if required. Performance Evaluation Every six months, representatives of the Town and the Community Services Group will meet to set goals and objectives for the provision of community recreation programs and services. A joint written report will be prepared as a product of such meeting on a semi- annual basis which will include an evaluation.of the adequacy of community recreational facilities, programs and services, and will, on at least an annual basis, include recommendations for the improvement of such facilities, programs and services. -2- Payment for Services The Community Services Group shall submit invoices for payments on a monthly basis for services provided during the preceding month. The Town shall process these invoices within ten working days following the receipt of same. Term of Agreement and Long Range Planning The term of this agreement shall be two years commencing on July 1, 1990. Over the next year the Town and Community Services Group will meet to discuss longer term leisure service programming. This discussion should focus on what services should be provided and who should provide them. This concludes a five month process and sets up an opportunity where the Community Services Group and the Town can work over the next too years to promote a long- term plan and relationship to benefit the citizens of Danville. The Community Services Group Board has authorized our Executive Director, David Stegman, to sign the Memorandum of Understanding and begin the procedures contained in the document. On behalf of Board and staff, I wish to extend my thanks to you, your fellow Town Council members and staff for all of your collective work on this matter.
