A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF DANVIH.E AUTHORIZING
THE PREPARATION OF A GENERAL PLAN AMENDMENT STUDY AND THE
CONCURRENT SUBMITTAL AND CONSIDERATION OF A REZONING-
PREIZMINARY DEVELOPMENT PLAN FOR A 1.78+
ACRE SITE IDENTIFIED AS ASSESSORS

WHEREAS, Estate of McCamly and Summerhill Development (Owners) and
Summerhill Development (Applicant) have submitted a request for. authorization of a
General Plan Amendment Study and concurrent Rezoning - Preliminary Development Plan
for a 1.78+ acre parcel located at the north side of Fostoria Way, adjacent to the westerly
boundary of the abandoned Southern Pacific right-of-way (further identified as Assessors'
Parcel Number 218-090-011); and
WHEREAS, the southern portion of the subject site is identified in the General Plan
for Residential - Multiple Family - Medium Density use (13-21 units/acre); and
WHEREAS, the property owner and applicant have requested that the Town of
Danville consider a General Plan Amendment to accommodate a Residential - Single
Family - Medium Density use (3-5 units/acre) development including this site; and
WHEREAS, the Town of Danville requires Town Council authorization prior to the
preparation of General Plan Amendment Studies; and
WHEREAS, the Town Council did consider the project proponent's request at their
hearing on September 4, 1990; and
WHEREAS, the Town Council did hear and consider all reports, recommendations,
and testimony submitted in writing and presented at the hearing; and
WHEREAS, a staff report was submitted recommending that the Town Council take
the following actions:
1. authorize the preparation of a General Plan Amendment Study;
2. direct the project proponents to concurrently submit a Rezoning -

Preliminary Development Plan application.
NOW, THEREFORE, BE IT RESOLVED THAT the Town Council of the Town of
Danville concurs with the recommendation of staff, as cited above and as outlined in
additional detail in the staff report prepared for this item dated September 4, 1990.
BE IT FURTHER RESOLVED THAT, in authorizing the above mentioned General
Plan Amendment Study, the Town Council is not indicating any predisposition to approve
the requested General Plan Amendment.
Approved by the Danville Town Council at a regular meeting on September 4, 1909, by
the following vote:
