HomeMy WebLinkAbout182-90RESOLUTION NO. 182-90 A RESOLUTION OF AWARD OF CONTRACT FOR THE PAVEMENT MAINTENANCE PROJECT - 1990 CONTRACT NO. 90-5 WHEREAS, the Town Council has previously approved a Pavement Maintenance Plan for the Pavement Maintenance Project - 1990 (Contract No. 90-5); and WHEREAS, the City Clerk of this Town did, in open session on the 23rd day of August, 1990, publicly open and read aloud the sealed bids received as required by law; and WHEREAS, Gallagher & Burk, Inc., is the low bidder on such Project; and WHEREAS, the City Engineer has recommended adoption of a resolution for the purpose of awarding a contract to the low bidder; and WHEREAS, the Town Council has previously budgeted $500,000 for the Project, and the total project cost is estimated to be $600,000; and WHEREAS, the Federal Emergency Management Agency has awarded a $14,000 grant to the Town for the purpose of repairing earthquake damage to E1 Pintado Road; now, therefore, BE IT RESOLVED, by the Town Council of the Town of Danville, that the Town Manager be, and hereby is authorized to execute, on behalf of the Town, Contract No. 90-5 with Gallagher & Burk, Inc. for the 1990 Pavement Management Program in the form as lodged with the City Clerk, together with such changes as may hereafter become necessary, provided such changes do not materially increase the Town's obligations thereunder; and be it FURTHER RESOLVED, that the City Clerk shall, within five (5) days of the adoption of this Resolution, transmit an Extract of Public Works contract award to the Department of Industrial Relations, Division of Apprenticeship Standards, P.O. Box 603, San Francisco, California, 94101. Should a finding of any discrepancy regarding the ratio of apprentices to journeymen be made, the Town shall notify the Division of Apprenticeship Standards of such findings; and be it FURTHER RESOLVED, that the Town Council hereby appropriates $86,000 from Gas Tax funds and $14,000 from FEMA funds for payments due on Contract 90-5. I hereby certify that the foregoing is a true and correct copy of a resolution duly passed and adopted by the Town Council of the Town of Danville, California, at a meeting thereof held on the 4th of September, 1990, by the following vote: AYES: GREENBERG, NOES: NONE ABSTAINED: NONE ABSENT: NONE LANE, RITCHEY, SCHLENDORF, SHIMANSKY ATTEST: APPROVED AS TO FORM:
