A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF DANVILLE
AUTHORIZING THE PREPARATION OF A GENERAL PLAN AMENDMENT STUDY
AND THE CONCURRENT SUBMITTAL AND CONSIDERATION OF A
REZONING - PRELIMINARY DEVELOPMENT PLAN FOR A
38.0 ACRE SITE IDENTIFIED AS ASSESSORS PARCEL NUMBER
#199-090-006 (JACKMAN (O) / ALTMANN (a)))
~EREAS, Jerald C. Jackman (Owner) has submitted a request for
a authorization of a General Plan Amendment Study and concurrent
Rezoning - Preliminary Development Plan for the 38.0 acre parcel at
the terminus of Montair Drive (further identified as Assessors'
Parcel Number 199-090-006; and
WHEREAS, the subject site is identified in the General Plan
for Rural Residential development, requiring developed parcels to
be a minimum of five acres in size; and
WHEREAS,the property owner and applicant have requested that
the Town of Danville consider a General Plan Amendment to
accommodate a residential development with eleven units and an
unsubdivided remainder; and
WHEREAS, the Town of Danville requires Town Council
authorization prior to the preparation of General Plan Amendment
Studies; and
WHEREAS, the Town Council did consider the project proponent's
request at their hearing on June 5, 1990; and
WHEREAS, a staff report was submitted recommending that the
Town Council take the following actions;

Authorize the preparation of a General Plan Amendment
Study
.
Direct the project proponents to concurrently submit a
Rezoning - Preliminary Development Plan application.
.
Direct the applicant to submit, as part of the
application for Rezoning - Preliminary Development Plan,
an alternate land use plan showing development consistent
with the existing density range covering the site (i.e.,
at a maximum density of one dwelling unit per acre and
reflecting the design directives of the Scenic Hillside
and Major Ridgeline Development Ordinance).

WHEREAS, the Town Council did hear and consider all reports,
recommendations, and testimony submitted in writing and presented
at the hearing;
NOW, THEREFORE, BE IT RESOLVED THAT the Town Council of the
Town of Danville concurs with the recommendations of staff and
authorizes the preparation of a General Plan Amendment Study with
a parallel Rezoning application, as cited above, and as outlined in
additional detail in the staff report prepared for this item dated
June 5, 1990.
BE IT FURTHER RESOLVED THAT, in authorizing the above
mentioned General Plan Amendment Study, the Town Council is not
indicating any predisposition to approve the requested General Plan
Amendment.
APPROVED by the Danville Town Council at a Regular Meeting on June
5, 1990 by the following vote:
