HomeMy WebLinkAbout095-90 RESOLUTION NO. 95-90 APPROVING THE GRADING FEE SCHEDULE FOR THE TOWN OF DANVILLE WHEREAS, on February 6, 1990 the Town Council adopted Ordinance 89-22 adopting a new Chapter 92-8, Grading to Title 9 (subdivisions) of the Town of Danville Municipal Code and repealing Contra Costa County Ordinance Code Division 716, Grading; and WHEREAS, Ordinance 89-22 stipulates that from time to time the Town Council shall adopt a resolution amending the Grading Schedule of Fees; and WHEREAS, it is necessary for the Town to revise its Fee Schedule to insure that charges compare more directly to the costs of processing services provided by the Town and to insure that the fees collected are both reasonable and non-discriminatory, the Town staff has evaluated the cost of providing grading and related services and has recommended a revised Fee Schedule; now, therefore, be it RESOLVED, by the Town Council of the Town of Danville that the Town Council hereby finds that grading fees shall be revised according to the attached Grading Fees Schedule. A. Under 50 cubic yards Fee = $100.00 B. Over 50 cubic yards The Grading Plan Check Fee shall be based on the summation of $50 plus a percentage of construction cost and a yardage fee in accordance with the schedule listed below. 1. PERCENTAGE OF CONSTRUCTION COST a. $0 - $10,000: 0.5% of the engineer's construction cost estimate; be $10,001 - $100,000: 1.0% of the engineer's construction cost estimate; C. $100,001 or greater: 1.5% of the engineer's construction cost estimate. 2. YARDAGE FEE a. 50 to 1,000 cubic yards: yards. $0.50 per 100 cubic be 1,001 - 10,000 cubic yards: cubic yards; plus $100 (for review); $0.10 per 100 soil report C® 10,001 or greater: $0.33 per each 100 cubic yards; plus $550 (for soil report review). Fee = $50 + B1 + B2 II. GliDING PEI~IT FEE The Grading Permit Fee shall be as determined by the latest adopted Uniform Building Code as published by the International Conference of Building Officials and as regionally adjusted for the San Francisco area. III. GRADING INSPECTION FEES Grading Inspection Fees shall be determined based on the following schedule. A. Under 50 cubic yards: Initial site investigation fee. inspection/ Fee = $100.00 Be Over 50 cubic yards: The Grading Inspection Fee shall be based on the summation of $50 plus a percentage of construction cost and a yardage fee in accordance with the schedule listed below. 1. PERCENTAGE OF CONSTRUCTION COST a. $0 - $10,000: 2.0% of the engineer's con- struction cost estimate; b. $10,001 - $100,000: 1.5% of the engineer's construction cost estimate; C. $100,001 or greater: 1.0% of the engineer's construction cost estimate. 2. YARDAGE FEE ae 50 - 1,000 cubic yards: $5 per 100 cubic yards or a minimum of $25; be 1,001 - 10,000 cubic yards: yards; $2 per 100 cubic c. 10,001 or greater: $1.10 per 100 cubic yards. Fee = $50 + B1 + B2 IV. DEBRIS/CLEAN UP DEPOSIT A deposit shall be paid at permit issuance to assure the clean up of the site and/or public right-of-ways. This deposit shall be $1,000/acre and may be returned to the applicant if it can be determined at certification of occupancy that the site and surrounding areas have been restored to their clean and ultimately improved condition. Vo SECURITIES A. Posting of securities. In order to ensure compliance with conditions of the permit, a grading permit shall not be issued unless the permittee shall first post with the City Engineer a bond, or financial instrument of credit approved by the City Attorney, executed by the owner and a corporate surety authorized to do business in the State of California. The bond is required to ensure that the work, if not completed in accordance with approved plans and specifications, will be corrected to eliminate hazardous conditions, to repair any damages that may occur, and restore site to an acceptable condition. This requirement may be waived at the discretion of the City Engineer if (s)he determines that: No hazardous or otherwise adverse situation is likely to occur as a result of incomplete or improper grading, and no conditions of the permit warrant a financial security guarantee to assure their satisfactory completion. But a security will be necessary in most cases for all slide repairs or geologic-hazard repairs. On developments where several projects are being constructed by one owner, a continuing (blanket) security or single letter of credit which will cover all such projects may be accepted and the amount determined by the City Engineer. B. Amount. The amount of a grading bond shall be based on 50% of the labor and material costs for earthwork, based on the project cut or fill volume, whichever is greater, and 100% of the cost of the drainage improvements and erosion control facilities, including earthwork. The City Engineer may decrease or increase, to a maximum of 100% of the cost, the amount of the security if the potential hazards or nature of the project justify such an amount.
