HomeMy WebLinkAbout082-90RESOLUTION NO. 82-90 A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF DANVILLE AUTHORIZING THE PREPARATION OF A GENERAL PLAN/SPECIFIC PLAN AMENDMENT STUDY AND THE CONCURRENT SUBMITTAL AND CONSIDERATION OF REVISED REZONING - PRELIMINARY AND FINAL DEVELOPMENT PLAN AND SUBDIVISION REQUESTS INVOLVING A 2.7+/-ACRE OPEN SPACE SITE IDENTIFIED AS A PORTION OF PARCEL "E" OF SD 7299 (BELLETERRE DANVILLE - - AHMANSON DEVELOPMENTS, INC.) WHEREAS, Ahmanson Developments, Inc. has secured previous approval for a 77- lot single family / 120-unit multiple family Planned Unit Development project in the Old Blackhawk Road Specific Plan Area (PUD 88-11 & SD 7299); and WHEREAS, subsequent to recording the single phase final map for the project and commencement of site preparation work, a major landslide was encountered at the eastern edge of the project, affecting the ability to establish the single family lots at the end of the planned future private cul-de-sacs identified as Chatelaine Ct. and Bonaire Ct. and the multiple family units along the northeast corner of the planned future private loop roadway identified as Promenade Lane; and WHEREAS, Ahmanson Developments, Inc. has suspended site preparation work in this area and has undertaken extensive slide corrective work; and WHEREAS, Ahmanson Developments, Inc. has advised the Town of Danville that a minimum of four single family lots and eleven multiple family units must be deleted from this portion of the project due to the presence of the slide and/or as a result of of the required slide corrective measures; and WHEREAS, Ahmanson Developments, Inc., as a result of the slide and related slide corrective work, has submitted a request for a authorization of a General Plan/Specific Plan Amendment Study and concurrent Revised Rezoning - Preliminary and Final Development Plan and Subdivision requests involving the 2.7 +/- acre Open Space site identified as a portion of Parcel "E" of SD 7299; and WHEREAS, the 27 +/- acre Open Space site is located along the eastern boundary of the Bellettere Danville Planned Unit Development project and is designated on the Final Map for SD 7299 for conveyance to the future project homeowner's association as common areas for the purpose of permanent open space, and is further identified as a portion of Assessor's Parcel Numbers 203-180-003, thru 006; 203-190- PAGE 1 OF RESOLUTION NO. 82-90 003, 004; 203-200-001 thru 004; and WHEREAS, the Town of Danville requires Town Council authorization prior to the preparation of General Plan/Specific Plan Amendment Studies; and WHEREAS, the Town Council did consider the applicant's request at their hearing on April 17, 1990; and WHEREAS, a staff report was submitted recommending that the Town Council take the following actions; . Authorize the preparation of a General Plan/Specific Plan Amendment Study. , Authorize the concurrent submittal and consideration of Revised Rezoning - Preliminary and Final Development Plan and Subdivision requests. . Direct the applicants to submit, as part of the applications, an alternate land use plan showing a potential lotting layout which limits the extent that residential development encroaches towards the project's eastern boundary to an extent which is equal to, or less than, that shown by the original Planned Unit Development Plan and Tentative Map approved for this site. o Direct the applicants to fund an independent "third party" geotechnical consultant review of the two land plans affecting the subject 2.7 +/- acre Open Space site, if deemed necessary by staff during the application review process. WHEREAS, the Town Council did hear and consider all reports, recommendations, and testimony submitted in writing and presented at the hearing; and WHEREAS, the Town Council cited various concerns and issues they felt were associated with the proposal to place a roadway and five residential lots in an area shown for Open Space use by the Old Blackhawk Road Specific Plan, including; potential visual impacts resulting from the "stacking affect" of the proposed residences - eliminating the open space swath for this portion of the eastern edge of the Plan Area, the loss of Open Space lands in general (seen as a scarce resource), and the potential for future problems resulting from placing residential units on top of the slide corrective work done in this portion of the PUD development; and WHEREAS, the approval of this Resolution authorizing a study of the proposed PAGE 2 OF RESOLUTION NO. 82-90 General Plan and Specific Plan amendments does not constitute approval or endorsement of the proposed amendments (themselves); NOW, THEREFORE, BE IT RESOLVED THAT the Town Council of the Town of Danville concurs with the recommendations of staff, as cited above and as outlined in additional detail in the staff report prepared for this item dated April 17, 1990.
