A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF DANVILLE
APPROVING THE APPLICATION FOR LAND AND WATER
CONSERVATION FUNDS FOR OAK HILL PARK AMPHITHEATER PROJECT
WHEREAS, the Congress under Public Law 88-578 has authorized the
establishment of a Federal Land and Water conservation fund Grant-
In-Aid Program, providing matching funds to the State of California
and its political subdivisions for acquiring lands and developing
facilities for public outdoor recreation purposes; and
WHEREAS, the State Department of Parks and Recreation is
responsible for administration of the program in the state, setting
up necessary rules and procedures governing application by local
agencies under the program; and
WHEREAS, said adopted procedures established by the State
Department of Parks and Recreation require the applicant to certify
by resolution the approval of applications and the availability of
local matching funds prior to submission of said applications to
the state; and
WHEREAS, the proposed Oak Hill Park Amphitheater project is
consistent with the Statewide Comprehensive Recreation Resources
Plan: California Outdoor Recreation Plan - 1988; and
WHEREAS, the project must be compatible with the land use plans of
those jurisdictions immediately surrounding the project;
NOW THEREFORE, BE IT RESOLVED by the Town Council of the Town of
Danville hereby:

Approves the filing of an application for Land and Water
Conservation Fund assistance; and

Certifies that said agency has matching funds from the
Town of Danville Park Fund, and can finance 100 percent
of the project, half of which will be reimbursed; and
BE IT FURTHER RESOLVED, that the Town Council hereby:

Approve the filing of an application for Land and Water
Conservation Fund assistance; and
·
Acknowledge that local funds are available for completion
of the project. The Town certifies that it has matching
funds from the Park Fund and can finance 100 percent of
the project, half of which will be reimbursed; and
·
Certify that the project is compatible with the land use
plans of those jurisdictions immediately surrounding the
project; and
·
Certify that it will sponsor the project and execute a
project agreement with the state if the project is
selected by the state for funding assistance under the
Land and Water Conservation Fund Program; and
·
Certify that the Town of Danville will be responsible for
submitting the grant application, plans and
specifications, and other documents to the state for
review and approval, and is responsible for day-to-day
administration of the grant project; and

Certify that it will assume, in perpetuity, total
responsibility for compliance with the terms and
conditions of the Project Agreement, including the
obligation to keep the site open and available for public
outdoor recreation purposes, and to maintain the property
consistent with the requirements of the Land and Water
Conservation Fund Act; and

Appoint the Danville Manager of Parks and Recreation to
serve as agent to work with the state in administering
the day-to-day responsibilities associated with the
grant·
APPROVED by the Danville Town Council at a Regular Meeting on March
20, 1990, by the following vote:
