HomeMy WebLinkAbout040-90 RESOLUTION NO. 40-90 APPROVING INCLUSION OF VOLUNTEERS IN WORKER'S COMPENSATION PROGRAMZ WHEREAS, the Town of Danville is permissibly insured for Worker's Compensation benefits which cover Danville employees; and WHEREAS, on June 19, 1989 Town Council approved the position of Volunteer Coordinator; and WHEREAS, one of the duties of the Volunteer Coordinator is to create a volunteer program which will utilize unpaid volunteers to perform duties for the Town; and WHEREAS, California Labor Code, Section 3363.5 provides that a person who performs voluntary service without pay for a public agency as designated and authorized by the governing body of the agency or its designees, shall upon adoption of a resolution by the governing body of the agency so declaring, be deemed to be an employee of the agency for purposes of this division while performing such service; and WHEREAS, the Town of Danville wishes to provide Worker's Compensation insurance coverage to its volunteers pursuant to such labor code section; therefore BE IT RESOLVED, by the Town Council of the Town of Danville that all volunteers who perform services for the ~own of Danville pursuant to the Volunteer Program are hereby granted employment status for purposes of Worker's Compensation Insurance.
