A RESOLUTION OF APPLICATION BY THE TOWN OF DANVILLE, REQUESTING THE
LOCAL AGENCY FORMATION COMMISSION TO TAKE PROCEEDINGS FOR AMENDMENT
OF THE SPHERE OF INFLUENCE AND ANNEXATION OF THE LAWRENCE ROAD AREA
TO THE TOWN OF DANVILLE
WHEREAS, the Town of Danville desires to initiate proceeding,
pursuant to the Knox-Cortese Local Government Reorganization Act
of 1985, Division 3, commencing with Section 56000 of the
California Government Code for Amendment of the Town~s sphere of
influence to include an approximately 356 acre area located on the
west and east sides of lawrence Road, south of Camino TassaJara,
and annexation of an approximately 197 acre area located on the
west side oflawrence Road adjacent to the existing Town limit~ and
WHEREAS, the territory proposed to be added to the sphere of
influence is rural residential, containing some 72 separate parcels
and 46 residential units and description of the boundaries of the
territory is set forth in Exhibit A attached hereto, and by this
reference incorporated herein; and
WHEREAS, the territory proposed to be annexed is rural
residential, containing some 33 separate parcels and 20 residential
units and a description of the boundaries of the territory is set
forth in Exhibit A (map) attached hereto and by this reference
incorporated herein; and
WHEREAS, it"is desired to provide that the proposed annexation
be subject to the following terms and conditions:
o The proposed annexation territory will be subject to the
rules, regulations, ordinances, indebtedness, and contractual
obligations of the Town of Danville.
o Contra Costa County General Plan land Use Designation have
been adopted by reference (Resolution No. 37-90) and will be
implemented by a pre-zoning of the area (Ordinance No 90-7),
consistent with the Townts General Plan policies and Zoning
Ordinance.
WHEREAS, the reasons for this proposed sphere of influence
amendment and annexation are as follows:
1) The territoryproposed has been developed in rural residential
densities for many years and is directly adjacent to the existing
Town Boundary.
2) The proposed annexation was promulgated by a petition signed
by a majority of the landowners in the Lawrence Road Area.

3) Proposed urban development (Windemere and Gale Ranch) adjacent
to Danville and the lawrence Road area will not occur under the
land use Control of the Town, and could result in adverse impacts
upon the social, physical, and economic conditions within the
existing Town.
4) The Town has adopted annexation policies that include:
o Evaluating the cost/revenue implications of all proposed
development projects within the Town's Sphere of Influence. A
cost/revenue_study has been conducted for the proposed annexation
territory that indicates that annexation can be fiscally positive
for the Town.
o Actively discouraging proposed developments which will not
likely contribute to the overall well-being of the community. The
proposed annexation will provide the Town with the land use
controls to assure development compatible with the Town's General
Plan and land use related ordinances.
o Actively encouraging through annexation, the full
participation of developing properties in the cost of providing
basic public services. Development of the proposed annexation
territory, because of its location east of the Sycamore Valley and
Crow Canyon Corridor Areas, will place major demands upon existing
public services and infrastructure within the Town of Danrills,
particularly roads and intersection improvements. Within the
Sycamore Valley and Crow Canyon Corridor Areas, the Town has
established public improvement financing plans that assure that
needed facilities are adequately funded. A similar financing plan
will be applied to the proposed annexation territory.
NOW,THEREFORE, this Resolution of Application is hereby
adopted and approved by the Town Council of the Town of Danville,
and the Local Agency Formation Commission of Contra Costa County
is hereby requested to take proceedings for the amendment of the
Sphere of Influence and annexation of the territories described in
Exhibit A according to the terms and conditions as stated above an
in the manner provided by the Cortese-Knox Local Government
Reorganization Act of 1985.
