HomeMy WebLinkAbout207-89 RESOLUTION NO. 207 - 89 APPROVING AND CERTIFYING MITIGATED NEGATIVE DECLARATION AND APPROVING ADDITIONAL APPROPRIATIONS FOR SYCAMORE VALLEY PARK WHEREAS, the Town Council has previously appropriated $2,577,632 for the design and construction of the Sycamore Valley Park, and; WHEREAS, additional project costs are projected to be $611,508 over the estimated cost due to necessary changes in the design of the Park; and WHEREAS, the approval of additional funding for Sycamore Valley Park is in the public interest, and will contribute to the benefit of the citizens of Danville; and WHEREAS, the Town has prepared and circulated for public review a Mitigated Negative Declaration of Environmental Significance pursuant to the California Environmental Quality Act (hereinafter "CEQA"), in connection with the construction of the park; and WHEREAS, such Mitigated Negative Declaration is based upon an Initial Study conducted pursuant to CEQA; and WHEREAS, such Mitigated Negative Declaration declares that the construction of the park will have a significant adverse impact on the environment, but that the mitigation measures contained herein reduce such impacts to an insignificant level; and WHEREAS, such Mitigated Negative Declaration, which is incorporated in full herein by this reference, contains a Mitigation Measure Reporting Program as required by CEQA; and WHEREAS, the Agency makes the following findings in connection with the approvals contained herein: 1. The Initial Study prepared on the basis of the proposed construction concluded that development pursuant to the project could have a significant effect on the environment; 2. Changes or alterations to the development have incorporated into construction of the park, which mitigate or avoid the potentially significant effects identified in the Intitial Study; 3. The Initial Study and Mitigated Negative Declaration have been prepared and completed in compliance with CEQA; 4. The Agency Commission has reviewed and considered the information contained in the Initial Study and Mitigated Negative Declaration, together with public comments on such documents, and finds that there is no substantial evidence that the project represented by proposed construction will have a significant effect on the environment. BE IT RESOLVED, by the Town Council of the Town of Danville that the proposed Mitigated Negative Declaration for the Sycamore Valley Park hereby approved; and be it FURTHER RESOLVED, that $1,786,508 from the following sources are hereby appropriated for the Sycamore Valley Park project: Park Fund Unappropriated Balances $611,508 Capital Improvement Fund East Area Benefit District Revenues 55,000 School District Contribution 320,000 Sycamore Valley Assessment Dist. 800,000 APPROVED BY the Danville Town Council at a regular meeting on November 20. 1989 by the following vote: AYES: GREENBERG, JAGGER, LANE, RITCHEY, SCHLENDORF NOES: NONE ABSTAINED:NONE ABSENT: NONE MAYOR ATTEST: APPROVED AS TO FORM:
