A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF DANVILLE
ESTABLISHING THE SATISFACTORY COMPLETION OF IMPROVEMENTS WITHIN
SUBDIVISION 6874, MEADOW CREEK II
WHEREAS, the City Engineer has notified this Council that the
improvements required as a condition of that Subdivision Agreement
between the Town of Danville and Olympia Properties, Inc., dated
July 6, 1987, have been satisfactorily completed; and
WHEREAS, it is in the interest of the Town of Danville to establish
those private improvements as completed within said subdivision;
and
WHEREAS, it is in the interest of the Town of Danville to accept
the public utility easements offered for public utility purposes;
and
WHEREAS, it is in the interest of the Town of Danville to reject
those storm drain easements which do not carry any drainage from
public streets and are the responsibility of the subject
subdivision homeowners; and
WHEREAS, it is in the interest of the Town of Danville to accept
those private streets within said subdivision for emergency
vehicular access only, and not for public maintenance; and
WHEREAS, it is in the interest of the Town of Danville to release
those securities guaranteeing performance of the Subdivision
Agreement; now, therefore,
BE IT RESOLVED, by the Town Council of the Town of Danville that
the private improvements required as a condition of the July 7,
1987 Subdivision Agreement between the Town and Olympia Properties,
Inc. are satisfactorily completed; and be it
FURTHER RESOLVED, that the Town of Danville hereby accepts those
Public Utility Easement, Streets and Parcels "A" and "B" for public
utility and emergency vehicular access only, and not for public
street purposes; and be it
FURTHER RESOLVED, that the Town of Danville hereby rejects those
Storm Drain Easements, (S.D.E.), which do not drain any public
street or facility, in favor of their private maintenance by the
homeowners of this Subdivision; and be it
FURTHER RESOLVED, that the Town staff is authorized and directed
to release the securities required as a condition of this
Subdivision in accordance with the Subdivision Agreement and the
Town Code.
PASSED, APPROVED AND ADOPTED this 20th day of November, 1989 by the
following vote:
