HomeMy WebLinkAbout172-89RESOLUTION NO. 172-89 APPROVING MEMORANDUM OF UNDERSTANDING ON CAMINO RAMON - FOSTORIA WAY CIRCULATION IMPROVEMENTS WHEREAS, in April, 1986, the City of San Ramon instituted a lawsuit against the Town of Danville and others regarding Danville's adoption of the so-called Fostoria Way General Plan Amendment which, among other things, provided that Camino Ramon would not be extended northerly to intersect with Fostoria Way; and WHEREAS, in December, 1986, Danville and San Ramon executed a written agreement in settlement of such litigation, which agreement required, the parties negotiate an agreement for the joint planning, financing, construction and maintenance of a Fostoria Way Overcrossing of the Interstate 680 freeway; and WHEREAS, on June 6, 1989, the voters of the Town of Danville enacted initiative Measure A which required that Camino Ramon be extended northerly to intersect with Fostoria Way; and WHEREAS, representatives of Danville and San Ramon have conducted numerous meetings to consider and address the issues of mutual concern raised by the 1986 Settlement Agreement and by Measure A; and WHEREAS, in response to Measure A, a Memorandum of Understanding has been negotiated which provides, among other things, for cooperation on a traffic circulation study, joint funding of the design and construction of traffic signals at the intersections of Fostoria Way and Crow Canyon Place, and Fostoria Way and Camino Ramon, a monetary contribution by San Ramon toward Phase I construction of the Camino Ramon extension, and a waiver of certain monetary claims in connection with the 1986 settlement agreement; now, therefore BE IT RESOLVED, by the Town Council of the Town of Danville, that the Town Manager is hereby authorized to execute, on behalf of the Town, a Memorandum of Understanding on Camino Ramon - Fostoria Way Circulation Improvements with the City of San Ramon, in the form as lodged with the City Clerk, together with such changes as may hereafter become necessary, provided such changes do not materially increase the obligations of the Town thereunder.
