RESOLUTION NO, 99-89
A RESOLUTION PRELIMINARILY APPROVING THE ENGINEER'S REPORT,
DECLARING ~ TD n~F.R,_LEVY AND COLLECTION OF
ASSESSMENTS AND PROVIDING FOR NOTICE OF HEARING THEREOF
DANVIT.T.F. STREET LIGHTING AND LANDSCAPE
ASSESSMENT DISTRICT 1983-1
RESOLVED, by the Town Council of the Town of Danville, County of
Contra Costa, California, that
1. On July 6, A3B9, this Town Council adopted Resolution
No. 89-89. A Resolution directing Preparation of Annual Report
for the Danville Street Lighting and Landscape Assessment
District 1983-1, (the "District"). Pursuant to said resolution,
a report, in a~ordance with Section 22565 et seg. of the
California Streets and Highways Code, has been made, filed with
the City Clerk, duly considered by this Council, and is hereby
deemed sufficient and preliminarily approved. Said report shall
stand as the Engineer's Report for all subsequent proceeding
under and pursuant to the foregoing resolution.
2. It is the intention of this Town Council to levy and collect
assessments within the Danville Street Lighting and Landscape
Assessment District 1983-1 for the fiscal year 1989-90. Within
said District, the existing and proposed improvements and any
substantial changes proposed to be made to the existing
improvements are generally as described on Exhibit A attached
hereto and hereby made a part hereof.
3. The Danville Street Lighting and Landscape Assessment
District include all parcels of land within the incorporated
limits of the Town of Danville.
4. Reference is hereby made to the aforementioned Engineer's
Report, on file with the City Clerk, for a full and detailed
description of the improvements, the boundaries of the proposed
maintenance assessment district and the proposed assessments upon
assessable lots and parcels of land within said district.
5. Notice is hereby given that on Monday, the 7th day of
August, 1989, at the hour of 7:30 o'clock p.m., in the regular
meeting place of this Town Council, 699 Old Orchard Drive,
Danville, California, a hearing by the Town Council will be held
on the question of the levy of the proposed assessment.
Prior to the conclusion of said hearing, any interested
person may file a written protest with said Clerk, or, having
previously filed a protest, may file a written withdrawal of that
protest. A written protest shall state all grounds of objection.
A protest by a property owner shall contain a description
sufficient to identify that property owned by such owner.
6. The city Clerk shall cause notice of said hearing to be
given by pubiishing a copy of this resolution once, at least ten
(10) day prior to the date of the hearing above specified, in the
Valley Times, a newspaper circulated in the Town of Danville.
I hereby certify that the foregoing resolution was duly and
regularly adopted by the Council of the Town of Danville, at a
regular meeting thereof held on the 17th day of July, 1989 by the
following vote, to wit:
AYES: Mildred Greenberg, Barbara Jagger, Beverly Lane,
Don Ritchey and Susanna Schlendorf
