HomeMy WebLinkAbout035-89 RESOLUTION NO. 35-89 AUTHORIZING THE EXECUTION OF AN AGREEMENT REGARDING PAYMENT OF CROW CANYON ROAD EXTENSION BENEFIT AREA FEES WHEREAS, on October 20, 1988, the Blackhawk Corporation ("Blackhawk") filed an appeal of the Danville Planning Commission's approval of PUD 88-10 (Tassajara Partners); and WHEREAS, the appeal was based upon an alleged violation of the terms of the February 10, 1987 Joint Exercise of Powers Agreement by and between Contra Costa County, the Town of Danville and the City of San Ramon regarding certain fees to be collected to reimburse certain of Blackhawk's expenses in connection with the extension of Crow Canyon Road to Camino Tassajara; and WHEREAS, the Town Council, Blackhawk and Tassajara Partners desire to compromise their pending dispute, and to that end have prepared a proposed "Agreement Regarding Payment of Fees From Tassajara Ranch (Crow Canyon Road Extension Fee Benefit Area)" dated March 16, 1989; now, therefore BE IT RESOLVED, by the Town Council of the Town of Danville that the Town Manager be, and hereby is authorized to execute said Agreement on behalf of the Town, in the form as lodged with the City Attorney, together with such changes as may hereafter become necessary, provided such changes do not materially increase the obligations of the Town thereunder. PASSED, APPROVED AND ADOPTED by the Town Council of the Town of Danville at the regular meeting duly held this 20th day of March, 1989, by the following vote: AYES: GREENBERG, JAGGER, LANE, RITCHEY, SCHLENDORF NOES: NONE ABSTAIN: NONE ABSENT: NONE ATTEST: APPROVED AS TO FORM:
