WHEREAS, Gerald L. Mixon, Trustee, is the owner of certain
property in the Town of Danville, Contra Costa County known as
Assessor's Parcel No. 217-010-005; and
WHEREAS, the Town of Danville adopted a resolution of need
and necessity to acquire such property on April 6, 1987 as
property designated for street widening and such use is
consistent with the general plan of the Town of Danville and such
acquisition for such purpose is in the public interest (Camino
Tassajara Road Widening Project, No. 4580-6X3261); and
WHEREAS, the acquisition of such property for that purpose
is categorically exempt and therefore, not subject to the
preparation and processing of environmental documents under the
California Environmental Quality Act; and
WHEREAS, Williams & Robbins, law offices, did file
condemnation proceedings on behalf of the Town and a settlement
proposal in the sum of $27,000 is acceptable to both the property
owner and the Town of Danville.
NOW, THEREFORE, THE TOWN COUNCIL OF THE TOWN OF DANVILLE,
HEREBY RESOLVES AS FOLLOWS:
1. The Town staff is authorized to complete the
acquisition of the above-identified property including
execution of necessary documents, payment of the
aforesaid purchase price, and accept and record a Grant
Deed in the Official Records of the County of Contra
Costa.
2. The sum of $27,000 is allocated to pay the aforesaid
purchase price together with such sums as are necessary
for closing, escrow an dpolicy costs. These amounts
shall be charged against the Sycamore Valley Assessment
District.
3. Williams & Robbins is authorized and instructe dto file
a dismissal of the above litigation and take such other
steps as necessary to terminate the condemnation
litigation.

Passed and adopted at a meeting of the Town Council held on
June 7 , 1988 by the following vote:
