A RESOLUTION OF NECESSITY OF THE TOWN COUNCIL
OF THE TOWN OF DANVILLE TO ACQUIRE STORM DRAIN
AND SEWER EASEMENTS BY EMINENT DOMAIN
FOR SUBDIVISION 6806, DANVILLE PLACE, ACROSS
ASSESSORtS PARCEL NO.218-090-11
WHEREAS, the Town Council on April 4, 1988, adopted a
resolution of intent to adopt this resolution of necessity; and
WHEREAS, the Town of Danville is vested with the power of
eminent domain to acquire private property for public use by
virtue of Article I, Section 19, of the Constitution of the
State of California, California Code of Civil Procedures,
Section 1240.010, 1240.030, 1240.050, 1240.110, 1240.120,
1240.210, etc.;
WHEREAS, notice has been given under Section 1245.235 of
the Code of Civil Procedures of the State of California, and all
owners and interested parties have been notified by mail on
April 15, 1988, as to the date, time, and place of this public
hearing; and
WHEREAS, the Town Council has heard all public testimony
from interested parties as to this matter.
NOW, THEREFORE, the Town Council of the Town of Danville
hereby resolves as follows:
1. Public interest and necessity require this project
consisting of acquisition of utility easements.
2. The project is planned and located in the manner that
will be most compatible with the greatest public good and the
least private injury.
3. The property to be acquired is necessary for the
project.
4. The offer of compensation required by Section 7267.2 of
the Government Code has been made to the owner or owners of
record.
5. The Town's general counsel, Charles Williams, and under
his supervision, special counsel as he may designated, are
hereby authorized, empowered, and directed to acquire in the
Town'~ name, by condemnation, %i%1e %0 %ho=e eamemen%~ demcribed
in the attached Exhibit "A" in accordance with the provisions
for eminent domain in the Code of Civil Procedures and
Constitution of the State of California. The Town's general
counsel shall prepare such documentation as is necessary for the
acquisition and prepare the necessary agreement with the
subdivider of Subdivision 6806, Danville Place, as identified in
the city policy for condemnation in Resolution No. 78-85.
PASSED, APPROVED AND ADOPTED by the Town Council of the
Town of Danville, on this 2nd day of May, 1988, by the following
vote:
AYES: Greenberg, Jagger, Lane, Ritchey, Schlendorf
NOES: None
ABSTAIN: None
ABSENT: None
