HomeMy WebLinkAbout049-88 RESOLUTION NO. 49-88 A RESOLUTION OVERRULING PROTESTS ON RESOLUTION OF INTENTION NO. 29-88 ASSESSMENT DISTRICT NO. 88-1 RESOLVED, by the Town Council of the Town of Danville, California, that WHEREAS, this Council did on March 31, 1988, adopt its Resolution of Intention No. 29-88, to acquire and construct public improvements in and for this Town; WHEREAS, on March 31, 1988, this Council adopted a resolution appointing time and place of hearing protests in relation to the proposed improvements and directing notice; WHEREAS, notice was given of the time and place therein stated in the manner provided by law, as appears from the certificates and affidavits on file in the office of the City Clerk; WHEREAS, said matter came on regularly for hearing at the time therein fixed; and WHEREAS, all written protests and other written communications were publicly read at said meeting and all persons desiring to be heard were fully heard; NOW, THEREFORE, IT IS FOUND, DETERMINED AND ORDERED, as follows: 1. Protests against the improvements were not signed by the owners of a majority or more of the area of the land within the assessment district, or of the area of the land to be assessed for the improvements. 2. The protests be, and each of them is, hereby, overruled. I hereby certify that the foregoing is a full, true and correct copy of a resolution duly passed and adopted by the Town Council of the Town of Danville, California at a meeting thereof held on the 2nd day of May , 1988 by the.following vote: AYES, and in favor thereof, Councilmembers: Greenberg, Jagger, Lane, Ritchey, Schlendorf NOES, Councilmembers: None ABSENT, Councilmembers: None ~~rr//J' ~~ ATTEST: ~'y~~Cr~j 3
