HomeMy WebLinkAbout032-88 RESOLUTION NO. 32'~ A RESOLUTION OF PRELIMINARY APPROVAL OF ENGINEER'S REPORT ASSESSMENT DISTRICT NO. 88-1 RESOLVED, by the Town Council of the Town of Danville, California, that WHEREAS, on the _tlslday OfMsrch , 1988, this Council did adopt its Resolution of Intention No. 21-88 , to acquire and construct improvements in and for this Town and did refer the proposed acquisitions and improvements to the Engineer of Work, being a competent person employed by this Town for that purpose and did therein direct the Engineer of Work to make and file with the City Clerk a report, in writing, all as therein more particularly described, under and pursuant to the Municipal Improvement Act of 1913, being Division 12 of the Streets and Highways Code of the State of California; WHEREAS, the Engineer of Work has made and filed with the City Clerk a report, in writing, as called for in the Resolution of Intention, and under and pursuant to said Act, which report has been presented to this Council for consideration; and WHEREAS, this Council has duly considered the report and each and every part thereof, and finds that each and every part of the report is sufficient, and that neither the report, nor any part thereof requires or should be modified in any respect; -1- NOW, THEREFORE, IT IS ORDERED, as follows: 1. That the plans and specifications for the proposed improvements to be made, contained in the report, be, and they are hereby, preliminarily approved. 2. That the general description of works or appliances already installed and any other property necessary or convenient for the operation of the improvement, if the works, appliances, or property are to be acquired as a part of the improvement, contained in the report, be, and they are, hereby, preliminarily approved. 3. That the Engineer's estimate of the itemized and total cost of said acquisitions and improvements and of the incidental expenses in connection therewith, contained in the report, be, and it is hereby, preliminarily approved. 4. That the diagram showing the assessment district referred to and described in the Resolution of Intention, and also the boundaries and dimensions of the respective subdivisions of land within the assessment district as the same existed at the time of the passage of the Resolution of Intention, each of which subdivisions has been given a separate number upon the diagram, as contained in the report, be, and it is hereby, preliminarily approved. 5. That the proposed assessments upon the several subdivisions of land in the assessment district in proportion to the estimated benefits to be received by such subdivisions, -2- i respectively, from the acquisitions and improvements and of the incidental expenses thereof, as contained in the report, be, and they are hereby, preliminarily approved. 6. That the proposed maximum annual assessment upon each of the several subdivisions of land in the assessment district to pay costs incurred by the City, and not otherwise reimbursed, which result from the administration and collection of assessments or from the administration or registration of any associated bonds and reserve or other related funds, as contained in the report, be, and the same are hereby, preliminarily approved. 7. That the report shall stand as the Engineer's Report for the purposes of all subsequent proceedings had pursuant to the Resolution of Intention. -3- r I hereby certify that the foregoing is a full, true and correct copy of a resolution duly and regularly passed and adopted by the Town Council of the Town of Danville, California, at a regular meeting thereof held on the 3ls~ day of M~rch , 198~ by the following vote: AYES, and in favor thereof, Councilmembers: Greenberg, Lane, Ritchey, Schlendorf NOES, Councilmembers: None ABSENT, Councilmembers: None ATTEST: -4-
