A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF DANVILLE
AUTHORIZING THE PURCHASE OF REAL PROPERTY FOR COMMUNITY PARK
PURPOSES·
WHEREAS, Ralph H. McRae and Joyce M. McRae, Trustees,
pursuant to that declaration of trust executed by Ralph H. McRae
and Joyce M. McRae on February 9, 1984, are the owners of
certain property in the Town of Danville, Contra Costa County
known as Assessor's Parcel No. 215-090-019; and
WHEREAS, the Town of Danville adopted a resolution of need
and necessity to acquire such property on August 18, 1986 as
property designated for a community park and such use is
consistent with the general plan of the Town of Danville and
such acquisition for such purpose is in the public interest; and
WHEREAS, the acquisition of such property for that purpose
is categorically exempt and therefore, not subject to the
preparation and processing of environmental documents under the
California Environmental Quality Act; and
WHEREAS, Williams & Robbins, law offices, did file
condemnation proceedings on behalf of the Town and a settlement
proposal in the sum of $1,300,000 is acceptable to both the
property owners and the Town of Danville·
NOW, THEREFORE, THE TOWN COUNCIL OF THE TOWN OF DANVILLE,
HEREBY RESOLVES AS FOLLOWS:

The Town staff is hereby authorized to complete the
acquisition of the above-identified property including
execution of necessary documents, payment of the
aforesaid purchase price, and accept and record a Grant
Deed in the Official Records of the County of Contra
Costa.

The sum of $1,304,000 is hereby allocated to pay the
aforesaid purchase price in the sum of $1,300,000 plus
closing, escrow and title policy costs in the sum of
$4,000·

Williams & Robbins is authorized and instructed to file
a dismissal of the above litigation and take such other
steps as necessary to dismiss and terminate such
condemnation litigation·
