HomeMy WebLinkAbout096-87RESOLUTION NO. 96-87 CERTIFYING NEGATIVE DECLARATION AND ENVIRONMENTAL ASSESSMENT FOR EL CERRO BOULEVARD EXTENSION WHEREAS, the Town of Danville caused an Environmental Assessment to be prepared to meet the requirements of both the National Environmental Policy Act (NEPA) and the California Environmental Quality Act (CEQA); and, WHEREAS, on May 31, 1985 the city Engineer for the Town of Danville approved the Environmental Assessment for circulation; and, WHEREAS, on May 21,1985 the Caltrans Chief of Local Assistance approved the Environmental Assessment for circulation; and, WHEREAS, on September 19, 1985, the Division Administrator of the Federal Highway Administration approved the Environmental Assessment for circulation; and, WHEREAS, on May 5, 1986 the Town of Danville amended the General Plan for the E1 Cerro Area; and, WHEREAS, in September 1986 the Town of Danville had updated traffic and noise studies for the Environmental Assessment; and, WHEREAS, the Town of Danville made the Environmental Assessment available to the public at least 30 days prior to the scheduled public hearing; and, WHEREAS, on November 6, 1986, the Town of Danville held a public hearing as a forum for discussion of the proposed location, right-of-way and major design features, and social, economic and other effects of the project; and, WHEREAS, the public record was open for ten days beyond the public hearing so that written statements and exhibits concerning the project could be submitted to the Engineering Department; and, WHEREAS, responses to written and oral comments were prepared; and, WHEREAS, on April 21, 1987 the City Engineer requested a Finding of No Significant Impact (FONSI) from the Federal Highway Admini~tration~ and, WHEREAS, on May 21, 1985 the Caltrans Chief of Local Assistance concurred with the request for a FONSI; and, WHEREAS, on August 31, 1987 the Division Administrator of the Federal Highway Administration issued a Finding of No Significant Impact (FONSI); and, WHEREAS, pursuant to Sections 15221-15225 of the Guidelines for Implementation of the California Environmental Quality Act the Town of Danville intends to utilize the federal documents in place of a Negative Declaration as it believes it meets the requirements of CEQA, Be it resolved, that with inclusion on the following mitigation measures the Town of Danville hereby finds that the project will not have a significant effect on the environment: · Run off during construction shall be controlled by constructing the bridge first. West Terrace Road shall be second and East Terrace section shall be last. This phasing will help direct runoff to existing catch basins rather than several points into the stream. Ground clearing shall be done in non-rainy season (between February and October) to reduce erosion of unvegetated slopes and services. 2 To reduce dust during construction activities exposed all surfaces shall be regularily sprinkled according to Caltrans standard specifications. · Large trees adjacent to the right-of-way or improvement edge will be preserved. Only trees on the terraces and trees which are (or may grow to be) over 30 feet on the slopes under the bridge shall be removed· Shrub removal shall be confined to areas needed for structural elements of the bridge· Creek slopes shall be planted with native species to recover wildlife habitat and to decrease erosion and runoff· · The project shall be limited to two travel lanes plus a left turn lane at the LaGonda intersection and shall be posted for a maximum speed of 35 M.P.H. The slower speeds will help retain some of the secluded nature of the area. e The new section of E1 Cerro Boulevard shall be striped for two traffic lanes (one in each direction). Bike lanes shall be provided for each directional travel. 6. The proposed traffic signal at Danville Boulevard and E1 Cerro Boulevard shall operate as a three phase signal. This would include a north/south phase, a westbound phase and a protected phase for southbound left turns. i . The Danville Boulevard/E1 Cerro Boulevard intersection shall be striped for at least two approach lanes on each leg. Each turning movement would have an exclusive lane. Consideration should be given to providing two exclusive through lanes in each direction of Danville Boulevard. Striped crosswalks will be provided at this intersection. · E1 Cerro Boulevard west of the bridge will be striped for a central two-way left turn lane and two parking lanes in addition to the two traffic lanes. . If any sub-surface deposits of an archaelogical nature (as described in the archaelogical survey report)are undercovered during the construction of the proposed project, work in the area must be halted and a qualified archaeologist will be contacted to evaluate the finds· Be it further resolved that the Town of Danville hereby issues a Negative Declaration for the E1 Cerro Boulevard Extension. The Town staff is hereby directed to file the Notice of Determination with the appropriate agencies. NOW, THEREFORE, IT IS BY THE TOWN COUNCIL SO ORDERED THAT the above recommendation is hereby approved.
