RESOLUTION NO. 13-87
A RESOLUTION OF THE TOWN OF DANVILLE
Regarding Mitigation Fees for Certain Projects in the
Unincorporated Area of the County Adjacent to Danville
WHEREAS, four development projects (West Branch, Morgan,
Tassajara Ranch, and Vista Tassajara) are now being considered
for development approval in the unincorporated areas within and
immediately adjacent to Danville's Sphere of Influence; and
WHEREAS, a tri-agency traffic study has been conducted for the
purpose of identifying transportation related mitigation
measures required by these projects; and
WHEREAS, based upon the traffic study and the environmental
documents for these projects Danville has identified specific
needs which must be met through the use of mitigation fees; and
WHEREAS, Danville, the County and the City of San Ramon have
conferred regarding these mitigation measures, and Danville
agrees that there is a need for the County to receive mitigation
fees for projects of mutual benefit to the County, the Town of
Danville, and the City of San Ramon.
NOW THEREFORE BE IT RESOLVED that Danville agrees as follows:

To assess a minimum mitigation fee of $4,900 per unit
for the Morgan, Tassajara Ranch and Vista Tassajara
projects·

To abide by the terms and conditions of the previously
executed Joint Exercise of Powers Agreement for
continuation of the Crow Canyon Benefit District·

To distribute $500 per unit of the fees collected from
the minimum total fee of $4,900 per unit plus $250,000
to Contra Costa County provided that the County uses
these funds to increase load-bearing capacity and
safety on Camino Tassajara east of Blackhawk, obtains a
federal grant valued at $750,000 and provides
additional funding in the amount of $250,000 for these
improvements.

To distribute $500 per unit from the minimum fee
collected of $4,900 to Contra Costa County for the
purpose of straightening and realigning the "so-called"
Bettencourt curve.

To distribute $1,000 per unit of the minimum fee of
$4,900 per unit to the City of San Ramon for certain
mitigation measures identified by San Ramon within its
community.

To retain the balance of fees collected to mitigate
transportation impacts within the Town of Danville.
AND, BE IT FURTHER RESOLVED that if both the County and the City
of San Ramon determine that the $4,900 mitigation fee is to be
increased that Danville shall proportionately increase its share
of the total mitigation fee.
AND, BE IT FURTHER RESOLVED that Danville agrees to implement
all provisions of this resolution as outlined above provided
that (1) both Contra Costa County and the City of San Ramon
collect and distribute to the Town of Danville a minimum
mitigation fee of $1,200 per unit for any residential units
constructed within the West Branch project, and (2) any amounts
in excess of $1,700 per unit allocated to the Crow Canyon
Benefit District are collected in addition to the minimum $4,900
per unit fee.
