HomeMy WebLinkAbout098-86Resolution No. 98-86 A RESOLUTION OF APPLICATION BY THE CITY COUNCIL OF THE CITY OF DANVILLE, REQUESTING THE LOCAL AGENCY FORMATION COMMISSION TO TAKE PROCEEDINGS FOR THE AMENDMENT OF THE CITY'S ADOPTED SPHERE OF INFLUENCE TO INCLUDE THE PROPERTIES LOCATED AT THE NORTHEAST AND NORTHWEST CORNERS OF BLACKHAWK ROAD AND CAMINO TASSAJARA, KNOWN AS THE BLACKHAWK OFFICE AND COMMERCIAL SITES, AND FOR ANNEXATION OF THIS AREA TO THE CITY OF DANVILLE WHEREAS, the City of Danville desires to initiate proceedings pursuant to the Knox-Cortese Local Government Reorganization Act of 1985, Division 3, commencing with Section 56000 of the California Government Code, for the annexation of an approximately 55 acre area, located adjacent to the easterly City Limits, abutting the existing Sphere of Influence on the south and east, known as the Blackhawk office and commercial sites. WHEREAS, the territory proposed to be annexed is uninhabited, and a description of the boundaries of the territory is set forth in Exhibit A (map) attached hereto and by this reference incorporated herein; and WHEREAS, the territory proposed to be annexed is not within City of Danville's adopted Sphere of Influence and amendment of the Sphere of Influence boundary is requested; and WHEREAS, it is desired to provide that the proposed Sphere of Influence boundary amendment and annexation be subject to the following terms and conditions: The proposed annexation territory will be subject to the rules, regulations, ordinances, indebtedness, and contractual obligations of the City of Danville. Contra Costa County General Plan land Use Designations will be adopted by reference and implemented by a pre-zoning of the area, consistent with the City's General Plan policies and Zoning Ordinance. Land Use entitlements, previously granted by Contra Costa County for development of the two sites will be adopted by the city, and development of the sites will be permitted to occur as specified in these approvals. WHEREAS, the reasons for this proposed Sphere of Influence boundary a~ndm~nt and annexation are as follows: l. The proposed annexation territory has been designated for urban development in Contra Costa County's San Ramon Valley Area General Plan. · The proposed annexation is the third phase of an overall Annexation Plan adopted by City of Danville by Resolution No. 63-86 for areas within and adjacent to its Sphere of Influence Area. · Urban development adjacent to Danville, not occurring under the direct land use control of the City, could result in adverse impacts upon the social, physical, and economic conditions within the existing City. · The City has adopted annexation policies and a master annexation plan which support annexation of the Blackhawk office and commercial sites· NOW, THEREFORE, BE IT RESOLVED this Resolution of Application is hereby adopted and approved by the City Council of the City of Danville, and the Local Agency Formation Commission of Contra Costa County is hereby requested to take proceedings for the amendment of the Sphere of Influence and for annexation of the territory as described in Exhibit A according to the terms and conditions as stated above in the manner provided by the Knox-Cortese Local Government Reorganization Act of 1985.
