HomeMy WebLinkAbout097-86Resolution No. 97-86 A RESOLUTION OF APPLICATION BY THE CITY COUNCIL OF THE CITY OF DANVILLE, REQUESTING THE LOCAL AGENCY FORMATION COMMISSION TO TAKE PROCEEDINGS FOR THE ANNEXATION OF THE BETTENCOURT/EDMONSTON RANCH PROPERTIES TO THE CITY OF DANVILLE WHEREAS, the City of Danville desires to initiate proceedings pursuant to the Knox-Cortese Local Government Reorganization Act of 1985, Division 3, commencing with Section 56000 of the California Government Code, for the annexation of an approximately 527 acre area, located east of Sycamore Valley within the City of Danville's Sphere of Influence Area, known as the "Bettencourt/Edmonston Ranch Properties"· WHEREAS, the territory proposed to be annexed is uninhabited, and a description of the boundaries of the territory is set forth in Exhibit A (map) attached hereto and by this reference incorporated herein; and WHEREAS, this proposal is consistent with the Sphere of Influence of the City of Danville; and WHEREAS, it is desired to provide that the proposed annexation be subject to the following terms and conditions: The proposed annexation territory will be subject to the rules, regulations, ordinances, indebtedness, and contractual obligations of the City of Danville. Contra Costa County General Plan land Use Designations will be adopted by reference and implemented by a pre-zoning of the area, consistent with the City's General Plan policies and Zoning Ordinance. WHEREAS, the reasons for this proposed annexation are as follows: . The proposed annexation territory has been designated for urban development in Contra Costa County's San Ramon Valley Area General Plan. · The proposed annexation is the second phase of an overall Annexation Plan adopted by City of Danville by Resolution No. 63-86 for the area east of the existing City limits· · Urban development adjacent to Danville, not occurring under the direct land use control of the city, could result in adv~ imDa~t~ uDon the social, Dhysical, and economic conditions within the existing City. · The city has adopted annexation policies and a master annexation plan which support annexation of the Bettencourt/Edmonston Ranch properties· NOW, THEREFORE, BE IT RESOLVED this Resolution of Application is hereby adopted and approved by the city Council of the city of Danville, and the Local Agency Formation Commission of Contra Costa County is hereby requested to take proceedings for the annexation of the territory as described in Exhibit B according to the terms and conditions as stated above in the manner provided by the Knox-Cortese Local Government Reorganization Act of 1985.
