HomeMy WebLinkAbout063-86Resolution 63-86 A RESOLUTION OF THE DANVILLE CITY COUNCIL ADOPTING A MASTER ANNEXATION PLAN FOR PROPERTIES EAST OF THE EXISTING CITY LIMITS WITHIN THE ADOPTED SPHERE OF INFLUENCE BOUNDARY WHEREAS, the Local Agency Formation Commission on November 14, 1984 adopted a Resolution establishing a Sphere of Influence for the City of Danville, and WHEREAS, the Knox-Cortese Local Government Reorganization Act of 1985, Division 3, commencing with Section 56000 of the California Government Code has established criteria for establishing Spheres of Influence and procedures for annexing territory within those Spheres of Influence, and WHEREAS, the City has adopted annexation policies that include: O Evaluate the cost/revenue implications of all proposed development proiects within the City's Sphere of Influence. A cost revenue study has been conducted for the proposed annexation territory that indicates that annexation can be more riscally positive for the City than development of the area without annexation. O Actively discourage proposed developments which will not likely contribute to the overall well-beinq of the community. The proposed annexation will provide the City with the land use controls to assure development compactible with the City's General Plan and land use related ordinances. O Actively encourage, through annexation. the full participation of developing properties in the cost of providing basic public services. Development of the proposed annexation territory,because of its location east of the Sycamore Valley Area, will place major demands upon existing public services and infrastructure within the City of Danville, particularly roads and intersection improvements. Within the Sycamore Valley Area, the City has established a public improvement financing plan that assures that needed facilities are adequately funded. A similar financing plan will be applied to the proposed annexation territory. WHEREAS, the City desires to annex those properties east of the existing City limits that are or may be included within the Sphere of Influence of Danville as indicated on the attached Exhibit A, and WHEREAS, the City desires to annex those properties in phases pursuant to a comprehensive program intended to include all properties within the Sphere of Influence in this area. NOW, THEREFORE, BE IT RESOLVED that a Master Annexation Plan for areas east of the existing City limits is hereby adopted as follows: 1. Phase 1 shall include the area on the south side of Camino Tassajara extending from Dougherty Road to the eastern Sphereof Influence boundary, referred to as the Dougherty Road Area and identified on the attached Exhibit B. 2. Phase 2 shall include the properties at the northeast and northwest corners of Blackhawk Road and Camino Tassajara known as the Blackhawk commercial and office projects; and shall include amendment of the Sphere of Influence to include these areas as may be required. 3. Phase 3 shall include the properties on the north side of Camino Tassajara referred to as the Bettencourt and Edmonston Ranch properties identified on the attached Exhibit C. 4. Phase 4 would be a future phase involving a variety of parcels including inhabited rural residential sites, properties not currently contemplating or approved for development, and the possible amendment of the Sphere of Influence boundary to incorporate additional area in order to meet the intent and purpose of the Knox-Cortese Local Government Reorganization Act of 1985, generally as shown on the attached Exhibit D.
