RESOLUTION NO. 20-86
A RESOLUTION OF THE DANVILLE CITY COUNCIL CERTIFYING REVIEW AND
CONSIDERATION OF FINAL ENVIRONMENTAL IMPACT REPORT, MAKING
FINDINGS WITH RESPECT TO SIGNIFICANT IMPACTS, AND ESTABLISHING
MITIGATION MEASURES FOR AMENDMENT OF THE GENERAL PLAN FOR THE
FOSTORIA WAY STUDY AREA (GPA 85-2).

WHEREAS, an environmental impact report (the "EIR") for
Fostoria Way Study General Plan Amendment (the "Project") was
prepared by the City of Danville (the "City") pursuant to the
California Environmental Quality Act (Public Resources Code
Sections 21000 et. seq., and the Guidelines for Implementation
of the California Environmental Quality Act (14 Cal. Adm. Code
Sections 15000 et. seq., hereafter the ("State EIR Guidelines");
and
WHEREAS, on November 7, 1985, the City forwarded the Draft
Environmental Impact Report to the State Clearinghouse for
distribution to those agencies which have jurisdiction by law
with respect to the Project, and other interested persons and
agencies, and sought the comments of such persons and agencies;
and
WHEREAS, notice of the completion of the Draft EIR was
mailed to all interested persons and agencies and was published
in the Valley Times on November 17, 1985; and
WHEREAS, the Draft Environmental Impact Report was
thereafter reviewed and supplemented to adopt changes suggested,
to incorporate comments received, and the City's response to
said comments, and as so revised and supplemented, a Final
Environmental Impact Report was submitted to the City Council of
the City of Danville; and
WHEREAS, the Planning Commission held a duly noticed public
hearing on the Draft EIR on December 12, 1985 and all persons
expressing a desire to comment thereon or object thereto having
been heard; and
WHEREAS, the Planning Commission on February 6, 1986 and
February 24, 1986 considered the Final EIR, which includes the
Draft EIR and the Responses to Comments document and recommended
to the City Council that the Final EIR be certified; and
WHEREAS, the City Council on March 17, 1986 considered the
Final EIR including all comments received and the reponse
thereto.

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF DANVILLE that:
A. The City hereby finds and certifies that the Final EIR
has been completed in compliance with the California
Environmental Quality Act, as amended ("CEQA"), and the State
EIR Guidelines, and that the City has reviewed and considered
the information contained in the Final EIR prior to making a
decision on the Project.
B. In accordance with Section 15091 of the State EIR
Guidelines, the City finds that the project will have the
following significant impacts and makes findings regarding their
mitigation:
1. Planning and Policy Context (Land Use)
a. Impacts:
(i)
Commercial uses in close proximity to residential
areas may result in conflicts due to incompatible
aspects associated with the commercial uses.
(ii)
Camino Ramon, if extended, will carry
substantially greater numbers of vehicles than
presently occurs.
(iii) Camino Ramon if not extended will result in a
disruption in the area circulation system,
precluding use of Camino Ramon as a through
street to relieve peak hour traffic congestion at
Crow Canyon Road.
(iv)
Emergency vehicle access through the Project may
be precluded if Camino Ramon is not extended.
b. Mitigation measures:
(i)
Mitigation measures contained on page 28 of the
Draft EIR are hereby incorporated as conditions
of Project approval except as modified below.
(ii)
The City finds that extension of Camino Ramon as
a through street would result in an extreme and
undue disruption of the residential neighborhoods
north of the Project and as such, the extension
should not occur.

(iii) To mitigate the impacts on emergency services to
the project and the surrounding area, and to
mitigate impacts on the area circulation system
the following mitigation measures are hereby
added:
O
Emergency vehicle access should be provided in
one or more locations such that through access
is provided for police and fire vehicles
linking the northerly and southerly ends of
Camino Ramon.
O
The City of Danville, the City of San Ramon
and developers of the Project should cooperate
towards determining the optimum solution to
cumulative traffic impacts in the vicinity of
the Project, particularly at the Crow Canyon
Road interchange with 1-680 and should further
cooperate in determining an equitable means of
funding any necessary traffic improvements.
2. Traffic and Circulation
a. Impacts:
(i)
Crow Canyon Road located south of the Project is
projected to reach 53,000 ADT when buildout of
the area is achieved. This will result in
congested conditions and undesirable levels of
service at certain intersections on Crow Canyon
Road.
(ii)
Unless Hilscher Way is realigned to intersect
Crow Canyon Road opposite Crow Canyon Place, the
majority of Project traffic would be concentrated
at the Crow Canyon Road intersection with Camino
Ramon, and on the portion of Camino Ramon north
of Crow Canyon Road. (Hilscher Way was required
to be realigned as part of the San Ramon Town
Center project located south of the project).
(iii) Development of the Project, particularly those
portions which access to the south, contribute to
cumulative traffic impacts which are projected to
create unacceptable traffic levels at the Crow
Canyon Road interchange with 1-680.
(iv)
Camino Ramon, if not extended, would not be
available as a alternative route to relieve
congested traffic conditions at the Crow Canyon
Road interchange with 1-680.

b. Mitigation Measures:
(i)
Mitigation measures contained on pages 41 and 42
are hereby referenced as general guides to
necessary mitigation. The following specific
mitigation measures are hereby incorporated as
part of Project approval.
(ii)
Mitigation measures cited in the above section
B.l.b (iii) are hereby incorporated as Traffic
and Circulation mitigations.
(iii) If development of the retail portions of the
Project precede completion of the realignment of
Hilscher Way, said realignment should be
completed by the Project developers subject to
reimbursable agreements as may be appropriate.
(iv)
Prior to granting of specific development
approvals for the Project:
o
individual developments shall conduct project
specific traffic studies which recommend
specific traffic mitigations, or
o
an acceptable comprehensive traffic study
shall be completed identifying needed
comprehensive traffic improvements, and
specifying means of funding any such
improvements.
3. Public Services and Utilities
a. Impacts:
(i)
Project development would contribute to the
cumulative impacts on the area-wide drainage
system reducing the remaining capacity of the
system.
(ii)
Water service to the Project by the East Bay
Municipal Utilities District (EBMUD) is dependent
on the completion of the Castenada Project.
Project development prior to completion of the
Castenada project may inhibit the ability of
EBMUD to serve the Project.
(iii) Wastewater that flows from the Project will
impact both collection systems and trunk sewers
in the vicinity of the Project reducing available
capacity.

(iv)
Students generated by the residential portions of
the Project will impact school facilities in the
San Ramon Valley Unified School District and may
result in overcrowding of schools.
(v)
The discontinuity of Camino Ramon through the
Project may inhibit accessibility to the Project
and the surrounding area by Police, and Fire
Protection personnel.
b. Mitigation Measures:
(i)
Mitigation measures contained on pages 56 through
59 of the Draft EIR are hereby incorporated as
conditions of Project approval except as modified
below.
(ii)
The City finds that extension of Camino Ramon as
a through street would result in an extreme and
undue disruption of the residential neighborhoods
north of the Project and as such the extension
should not occur. Mitigation measures cited in
the above Section B.l.b (iii) are hereby
incorporated as Public Services and Utilities
mitigations.
4. Natural Factors:
a. Impacts:
(i)
The occurrence of an earthquake could subject the
Project to earth shaking, liquefaction and loss
of strength in the soils to support structures
and utility lines.
(ii)
The shrink-swell characteristics of the Project
soils could result in disruption of building
foundations and breaks in underground utility
lines.
b. Mitigation Measures
(i)
Mitigation measures contained on pages 63 and 64
of the Draft EIR are hereby incorporated as
conditions of Project approval except as modified
below.

Mitigation measures listed on page 64 applicable
to the agricultural use of the Borel project are
not adopted. The loss of agricultural land
associated with development of the Borel property
is discussed in a later section of this
Resolution as an unavoidable adverse impact.
5. Other Environmental Considerations
a.
Impact: Noise impacts generated by traffic on 1-680
may exceed acceptable levels for planned
developments within the project, particularly
residential development in close proximity to
1-680.

Mitigation measures C-1 contained on pages 73 and 74 of
the Draft EIR is hereby incorporated as a
condition of Project approval.
C. Pursuant to section 15089 of the State EIR Guidelines,
the City finds that implementation of the project will have the
following significant impacts which are unavoidable: loss of
agricultural land, introduction of urban pollutants to storm
flows, a permanent change in the visual quality from a rural
setting to one of urban type structures, increased traffic,
increased noise levels, and demand for expansion of the urban
services network. The City allows these impacts to occur due to
the following: 1) the Project is in a highly urbanized area
where agricultural enterprise is no longer an appropriate or
compatible use of property; 2) all surrounding properties have
been removed from agricultural production; 3) development of
the Project will contribute to the vitality of the community
through provision at services and revenues to the City; and 4)
development of residential, particularly multiple family
residential, uses on the property will assist the City in
providing needed housing stock partially satisfying goals of the
Housing Element.

D. Upon approval of the Project by the City Council, the
City Clerk is hereby directed to file a Notice of Determination
with the County Clerk of Contra Costa County pursuant to the
provisions of Section 21152 of the Public Resources Code and the
State EIR Guidelines adopted pursuant thereto.
