BEFORE THE CITY COUNCIL OF THE CITY OF DANVILLE
In the Matter of:
Reverting to Acreage
Subdivision 5285
RESOLUTION NO. 5-86
On or about August 30, 1979, Contra Costa County approved
the tentative subdivision map for Subdivision 5285;
On July 1, 1982, the City of Danville incorporated and the
subdivision became subject to the jurisdiction of the City. On
April 18, 1983, the City of Danville approved the Final Map and
on that same date entered into a subdivision agreement providing
for the construction and installation of certain subdivision
improvements within a specified period of time;
The City of Danville did on May 8, 1984, adopt Resolution
No. 30-83 extending the time within which the sub-improvements
were to have been constructed and installed to April 18, 1985;
The applicant has requested an additional extension and on
October 28, 1985, the Planning Commission refused to grant the
extension and recommended that the subdivision either be
reverted to acreage or that the final map be rescinded by mutual
consent between the City and the applicant;
On December 16, 1985, the city Council initiated proceedings
for the reversion of the subdivision to acreage;
Notice of the time and place of the public hearing was given
in the time and manner provided in Section 66451.3 of the
Government Code and thereafter a public hearing was held on the
question of reverting Subdivision 5285 to acreage.
NOW, THEREFORE, the City Council of the City of Danville
finds, determines and orders as follows:
1. The dedications or offers of dedication which would be
vacated or abandoned by the reversion to acreage are unnecessary
for present or prospective public purposes; and
2. None of the improvements required to be made have been
made within the time allowed by the subdivision agreement for
completion of the improvements.

3. The subdivided real property known as Subdivision 5285
is reverted to acreage and reversion shall be effective upon the
filing for record by the County Recorder of the Final Map as
provided in Government Code Section 66499.18.
4. All previously paid fees shall be retained by the City
of Danville.
5. Any portion of required improvements security or
deposits obtained may be retained if they are necessary to
accomplish the purposes of the Subdivision Map Act or local
ordinance.
PASSED AND ADOPTED by the City Council of the City of
Danville this 20th day of February , 1986, by the following
vote:
