RESOLUTION APPROVING REPORT AND ASSESSMENT
AND ORDERING IMPROVEMENT
ASSESSMENT DISTRICT NO. 1988-1, SYCAMORE VALLEY
The City Council of the City of Danville resolves:
This Council has taken a series of actions preliminary to
ordering the improvement in Assessment District No. 198§-1, Sycamore
Valley, City of Danville, Contra Costa County, California, and now
makes the following findings and orders:
1. The Council adopted a map showiLg the boundaries of
the land benefited by the proposed improvement. A copy of the
boundary map was filed in the office of the County Recorder of the
County of Contra Costa in the Book of Naps of Assessment Districts.
2. The Council adopted its Resolution of Intention to
order the improvement described therein under the Municipal
Improvement Act of 1913, and directed BISSELL g KARN, INC., as the
Engineer of Work for the assessment district, to prepare the report
required by Section 10204 of the Streets and Highways Code.
The boundary map and resolution of Lntention were later
amended.
The improvement is generally described as follows:
The improvement of Camino Tassajara Parkway from Diablo
Road to the eastern city limit of Danville; Sycamore
Valley Road from Highway 1-680 to Camino Tassajara and
Diablo Road at Camino Tassajara by ~he installation of
grading, paving, curbs and gutters, hydrants, storm
drains, sanitary sewer mains, median landscaping,
sidewalks, bus turnouts acoustical walls, bridge widening
and traffic signalization.
The acquisition and improvement of a 20-acre community
park in the vicinity of Camino Tassajara and Sycamore

Valley Road; the improvement of the freeway interohange at
Syoamore Valley Road and Highway 1-680, inoluding overpass
widening, realigr~ment of existing ramps and improvements
to the approaohes; and funding of a prorata share of the
oost of acquiring a site and oonstruoting and equipping a
fire station to the speoifioations of the San Ramon Valley
Fire Proteotion Distriot, together with all appurtenanoes
and the aoquisition of all necessary interests in real
property.
3. The Engineer of Work filed the report as direoted, and
the City Courtoil oalled a hearing on the report as required by
Seotion 10301 of the Streets and Highways Code. Notioe of the
hearing was given By publication, By street posting and By mailing
to affeoted property owners, all aooording to the Munioipal
Improvement Aot of 1913. Affidavits of publication, posting and
mailing were filed with the City Clerk.
4. At the time and plaoe for whioh notioe was given, the
City Counoil opened and oontinued the publio hearing. At the time
of the oontinued publio hearing, the City Courtoil oonducted the
publio hearing and gave every interested person an opportunity to
objeot to the proposed improvement, the extent of the assessment
distriot, or the proposed assessment. FollowLng the hearing, at the
direotion of the Courtoil, the Engineer of Work filed an amended
report.
§. The Courtoil finds that written protests against the
proposed improvement have not been made By owners representing more
than one-half of the area of the land to Be assessed for the
improvement.
6. The doouments and events desoribed in paragraphs I to
4, inolusive, are stated here in tabular form, with their dates and,

where appropriate, their numbers. All documents are now on file
with the City Clerk.

7. The Council approves the Amended Engineer's Report and
each component part of it, including each exhibit incorporated by
reference in the report.
8. The Council finds that the Engineer of Work, in the
Amended Engineer's Report has fairly and properly apportioned the
cost of the improvement to each parcel of land in the assessment
district in proportion to the estimated benefits to be received by
each parcel, respectively, from the improvement. The City Council
hereby confirms and levies each individual assessment as stated in
the Amended Engineer's Report.
9. This City Council orders the improvement described in
paragraph 2 and as detailed in the Amended Engineer's Report.
10. Serial bonds representin~ unpaid assessments, and
bearing interest at a rate not to exceed twelve percent (12%) per

annum, will be issued in the manner provided by the Improvement Bond
Aot of 191§ (Division 10, Streets and Highways Code), and the last
installment of the bonds shall mature not to exoeed nineteen (19)
years from the seoond day of September next su¢oeeding twelve (12)
months from their date.
ll. Aooording to Seotion 10603 of the Streets and
Highways Code, the Courtoil designates the City Treasurer to oolleot
and reoeive payment of the assessments.
PASSED, APPROVED AND ADOPTED on November 7, 1985, by the
following vote, to wit:
