A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DANVILLE
ADOPTING CERTAIN AMENDMENTS TO THE SYCAMORE VALLEY SPECIFIC PLAN
REGARDING THE PUBLIC IMPROVEMENT REQUIREMENTS OF THE PLAN.
WHEREAS, implementation of the Sycamore Valley Specific
Plan has resulted in identification of several aspects of the
public improvement requirements contained in the Plan which need
to be amended; and
WHEREAS, the City Council on June 17, 1984 considered a
report titled "Sycamore Specific Plan Assessment District
Proposed Scope of Improvements", wherein proposed changes to the
Specific Plan text are stated relating to methods offinancing
and specific roadway, creek, water and sewer, park, firehouse
and otherimprovements; and
WHEREAS, the City Council referred this report
to the Planning Commission and requested the Commission's report
and recommendation on necessary amendments to the Plan to
achieve the objectives outlined in the report, and
WHEREAS, the Planning Commission, after conducting
a duly noticed public hearing in joint session with the City
Council, adopted Resolution No. 85-4 recommending that the
Sycamore Valley Specific Plan be amended in accord with Exhibit
A of said Resolution; and
WHEREAS, the City Council has held a duly noticed
public hearing on July 3, 1985 in joint session with the
Planning Commission to consider the proposed Specific Plan
amendments, and
WHEREAS, the City staff has presented substantial
factual information regarding the proposed Specific Plan
amendments, and
WHEREAS, the Planning Commission has considered all
public testimony and information presented during the public
hearing regardibg the Specific Plan amendments; and
WHEREAS, the City Council has determined
that the Final EIR for the Sycamore Valley Specific Plan
certified by the Contra Costa County Board of Supervisors in
!980 in conjunction with the Addendum thereto accepted by the
Danville Planning Commission on February 27, 1985 satisfy the
requirements of the California Environmental Quality Act with
regard to the proposed Specific Plan amendments, and
_.b'HEREAS, the City Council has determined that
the following findings exist in support of the proposed Specific
Plan amendments:
1. The proposed amendments are consistent with the
applicable sections of the adopted Danville General
Plan;
2. The proposed amendments will establish public
improvement requirements which will better carry out
the goals, policies and intent of the Sycamore Valley
Specific Plan; and
3. It is in the public interest to amend the Sycamore
Valley Specific Plan in order to facilitate public
improvement requirements which address circumstances
which have changed since the original adoption of the
Plan.
WHEREAS, the City Council has concluded that the
stated findings meet the requirements of Section 65453 of the
Planning and Zoning law for the amendment of specific plans.
NOW, THEREFORE BE IT RESOLVED THAT the City Council
hereby amends the Sycamore Valley Specific Plan as indicated in
the attached Exhibit A including: Sycamore Valley Specific Plan
(as revised) and Sycamore Specific Plan Assessment District
Proposed Scope of Improvements dated July 3, 1985.
The Plan and Scope of Improvements shall be modified
as follows:
1. The Sycamore Valley Specific Plan shall be modified as
followsz
a. Technical chanqes as recommended by staff

sentence; delete the word" irrevocably "

"Roadway Requirements", 2nd paragraph in its
entirety; should be included in "Community Parks and Open Space
Maintenance" and "Fire Requirements".

entirety.

as follows:
"Private Utility Requirements" paragraph shall read
"All power, communications, and other utility lines along
Camino TaBsajara between Sycamore Valley Road and Camino
Blackhawkshall be underground. The design of future high
voltage linee shall be resolved prior to the filing of the first
Final Development Plan. Cost of undergrounding major high
voltage transmission lines on Camino TassaJara shall not exceed
$900,000. If the cost exceeds that figure then the major high
voltage lines may be left above ground at the discretion of the
City."

"Roadway Requirements", 1st paragraph shall remain as stated
and A new paragraph inserted at the end tQ read:
Page 23 "once a written agreement has been reached between
the City and CalTrans which assures funding and construction of
the 1-680/Sycamore Valley Road interchange in conformance with
the intent of this plan, then the matrix requirements regarding
the issuance of building permits will have been satisfied."
2. The Assessment District's Proposed Scope of Improvements
shall be modified as follows=
a. Technical changes as recommended b_~ staff
Page 8 3rd paragraph, 4th line; substitute the word
"continuity" in lieu of "conformity".
Paae 9 1st paragraph shall be deleted.
Paae 16 Last paragraph, 2nd linel after the word "signal",
delete "and an".
Page 18 Paragraph 3 shall be modified as follows: "If
improvements are undertaken on a project by project basis, each
developer shall also be responsible for mitigating any
downstream or upstream deficiencies necessary."
Page 24 Paragraph I shall be modified as follows. Insert
after the second sentence ending with "...fair share of the
Assessment District improvements." the following: "A Benefit
District may be established at the time of formation of the
Assessment District to implement non-participating property
owner participation."
