HomeMy WebLinkAbout097-84 RESOLUTION NO. 97 -~4 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DANVILLE Approving a negative declaration and amending the General Plan to provide a limited office designation at property on the south side of Hartz Avenue between Laurel Road and Hartz Court. (A.P.N. 216-102,005 and 006) (G.P.A. 84-4) (Regarding the General Plan Amendment) a. Sections 65350 and 65361 of the Government Code of the State of California prescribe the procedure for adopting and amending the City's General Plan; and b. by Resolution No. 28-82, on October 1 1982, this Council adopted the General Plan for the City of Danville; and c. a proposal was submitted (G.P.A. 84-4) to amend the General Plan by providing for a limited office designation for l~ acres located south of Hartz Avenue between Laurel Road and Hartz Court (A.P.N. 216-102-005 and 006). This requires a change from the present designation of Multiple Family Residential, Medium Density; and d. after notice and hearing on the proposed amendment, the Planning Commission declined to recommend an amendment to the General Plan; and e. the applicant appealed the Planning Commission decision and, after proper notice, the City Council on September 17, 1984, held a public hearing on the proposed amendment to the General Plan; and f. the City Council believes that the limited office designation is appropriate at this site and will not create a precedent for other, undesirable, land use changes beyond the boundaries of this project; and -1- (Regarding the Negative Declaration) g. the California Environmental Quality Act of 1970, as amended, Sections 15070 through 15075, specifies the procedure for preparing, considering and approving a Negative Declaration of Environmental Impact; and h. on August 13, 1984, the Planning Commission considered and voted to approve a Negative Declaration of this proposal; and i. at its regular meeting on September 17, 1984, the City Council considered the recommendation to grant a Negative Declaration. NOW THEREFORE the City Council of the City of Danville hereby RESOLVES that: 1. The Negative Declaration prepared for G.P.A. 84-4 is approved, including mitigation measures, as shown in the attached Exhibit B. 2. The General Plan Map is amended to provide a limited office designation at the property south of Hartz Avenue between Laurel Road and Hartz Court as shown on the attached Exhibit A. 3. By this action, it is the Council's intention to limit the southerly boundary of the limited office designation in this area. 4. The Planning Director is directed to incorporate the changes into the General Plan. Name of Project: Ch~m~lin m CQtton neve]opmgnt Company Project Number: GPA-84-4 Location of Project: 95 ~na 50 La,,re] Drive Description of Project: There is a request for a General Plan Amendment changing the designation of the property from Multiple Family Residential Medium Density, 13-21 units per acre to Limited Office. The applicant proposes the construction of professional (excluding medical) offices. The property is comprised of two lots of approximately equal size, totalling .897 acres. The preliminary development plan shows a site plan for 8,200 square feet of office space in a two-story structure on one lot. The second lot would be developed in a similar fashion. Danv(ll~ CA 94596 r~t 9 Mitigation measures included in the project to avoid potentially significant impacts: Development of the property for office uses will result in removal of land now designated for Multiple Family Residential on the General Plan. Total unit loss is in the area of 13-21 multiple units. Project site is located within transitional area, across from anticipated commercial and office development on the Charlotte Wood school site. Conversion of the site to Limited Office may result in pressures for land use changes on adjacent single family residences planned for multiple residential. Site is located adjacent to the 1-680 freeway corridor; mitigation of high noise levels should be addressed at the time of plan submittal. Project design shall include landscape buffering to residential, screening parking areas, and siting of buildings to reduc blocking of views and st Jew effects on adjacent residences. Architectural compatibility with ~-~ ~ ~X~gp~n~ in thQ area shall be considered. this proposal. Water and sewer are available to the site, although upsizing of the water meters may be required. The site is easily accessible ~o Fire Department vehicles; fire flows and mains are considered adequate. An additional fire hydrant may be required at the time of development. Project subject to all requirements of Fire District Ordinance 4, which requires all new commercial development to be fully sprinklered and to have an approved Central Station supervised sprinkler system. The Police Department recommends the installation of pre-streamlined alarm systems to reduce the false alarm rate of all office and commercial developments. Project can be expected to generate 80± employees within area and attendant peak hour traffic. Site specific traffic impacts may need to be addressed at the time of development plan submittal to address the cumulative effects of increased traffic generated by this and other projects and impact of possible Laurel Drive extension through the Charlotte Wood school site. Temporary construction impacts, such as noise and dust, may be mitigated by limiting construction hours of operation and watering of the site during construction. Fiscal impacts of office development may be addressed at the time of plan submittal.
